AGENDA TITLE: Adopt Resolution Appropriating Funds for Emergency Removal of
Underground Fuel Storage Tanks at 230 West Elm Street ($25,000), Affirm
City Manager's Emergency Action, and Authorize up to an Additional $15,000

RECOMMENDED ACTION: That the City Council adopt a resolution appropriating funds ($25,000)
for the emergency removal of two underground fuel storage tanks at
230 West Elm Street, affirm the City Manager's emergency action, and
additionally give the City Managerthe authorityto authorize upto
an additional $15,000.
BACKGROUND INFORMATION: Two underground fuel tanks located behind the Public Safety
Building have served the Civic Center operations since 1988. One
12,000 -gallon tank was used for unleaded fuel, and one
2,000 -gallon tank was used for diesel fuel. The unleaded fuel was
used for fueling City vehicles, and the diesel fuel was used for powering the emergency generatorthat
serves the building. The tanks and gasoline dispenser have had regulatory compliance issues, and in
early January 2004, the unleaded dispenser was shut down, with City vehicles being directed to use the
fueling facilities at the Municipal Service Center.
Following a meetingwith San Joaquin County's Environmental Health Department in early February, staff
determined the cost to upgrade and maintain the site would be significantly more than closing it. The
City Manager approved that the City move forward on an emergency basis to have the two tanks,
dispenser, and associated piping removed immediately, and the work began.
Public Works staff solicited proposals from four contractors. Three quotes were received, and the lowest
responsible one was from Jim Thorpe, Inc., at $13,747. The contractor removed and disposed of the
two tanks on February 17t". Soils testing results indicate contamination under one of the tanks.
The Environmental Health Departmentwi I I dictate the extent of additional work required by the
end of this week. Based on past experience, the contractor recommends that the City be
prepared to spend up to an additional $15,000. The appropriation also includes County permit fees,
soils testing, asphalt replacement, and other associated miscellaneous costs.

A RESOLUTION OF THE LODI CITY COUNCIL APPROPRIATING
FUNDS FOR EMERGENCY REMOVAL OF UNDERGROUND FUEL
STORAGE TANKS AT 230 WEST ELM STREET
WHEREAS, two underground fuel tanks located behind the Public Safety Building at 230 West
Elm Street have served the Civic Center operations since 1988; and
WHEREAS, one 12,000 -gallon tank was used for unleaded fuel, and one 2,000 -gallon tank was
used for diesel fuel; and
WHEREAS, the tanks and gasoline dispenser have had regulatory compliance issues, and in
early January 2004, the unleaded dispenser was shut down; and
WHEREAS, following a meeting with San Joaquin County's Environmental Health Department in
early February 2005, it was determined that the cost to upgrade and maintain the site would be
significantly morethan closing it: and
WHEREAS, the City Manager approved that the City move forward on an emergency basis to
have the two tanks, dispenser, and associated piping removed immediately; and
WHEREAS, staff solicited proposals from four contractors and received three responses, with the
lowest responsible bid from Jim Thorpe, Inc., in the amount of $13.747; and
WHEREAS, staff recommends appropriating $25,000, which also includes funds for the County
permit fees, soils testing, asphalt replacement, and other associated miscellaneous costs, from the
General Fund Capital for this project; and
WHEREAS, staff further recommends that the City Council authorize the City Manager to
appropriate up to an additional $15,000 for soil contamination cleanup should it be necessary, pending
direction from the Environmental Health Department.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby appropriate
$25,000 for the emergency removal of underground fuel storage tanks at 230 West Elm Street from the
General Fund Capital reserve; and
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to appropriate an
additional $15,000 from the General Fund Capital Reserve for soil contamination cleanup should it be
necessary, pending direction from the Environmental Health Department.
