HomeMy WebLinkAboutAgenda Report - February 16, 2005 E-06AGENDA ITEM E-6 CITY OF LODI COUNCIL COMMUNICATION M AGENDA TITLE: Adopt Resolution Accepting Improvements in Legacy Estates Unit 1, Tract No. 3260 MEETING DATE: February 16,2005 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council adopt a resolution accepting the development improvementsfor Legacy Estates Unit 1, Tract No. 3260. BACKGROUND INFORMATION: Improvements at Legacy Estates Unit 1, Tract No. 3260, have been completed in substantial conformancewith the requirementsof the improvement agreement between the City of Lodi and FCB Building Partners II, L.P., as approved bythe City Council on November 19,2003, as amended by the City Council on February 2,2005, and as shown on Drawings No. 003DO01 through 003DO13 and 003DO31 through 003D040. At the Council meeting of February 2, 2005, Council adopted a resolution allowing the acceptance of public improvementsfor Legacy Estates Unit 1 prior to the completion of the Harney Lane improvements. Council also approved a new improvement agreement with DSS Company to cover the completion of the Harney Lane improvements at this same meeting. Staff is recommending that Council accept the street improvements in the interior streets of this development, the bicyclel pedestrian pathway along the east side of Larson School, and the blockwall and landscaping along Harney Lane. The bicycle Ipedestrian pathway and the blockwall and landscaping along Harney Lane were all included in the original improvement agreement for Legacy Estates Unit 1. The streets to be accepted are as follows: Streets Olson Drive Katzakian Way Giannoni Way Tehama Drive Pinkerton Way Lynch Way Legacy Way Total New Miles of City Streets FUNDING: Not applicable. That all requirements of the Improvement Agreement between the City of Lodi and FCB Building Partners 11, L.P., for Legacy Estates Unit 1, Tract No. 3260, have been substantially complied with. The improvements are shown on Drawing Nos. 003DO01 through 003D013 and 003DO31 through 003D040, on file in the Public Works Department and as specifically set forth in the plans and specifications approved by the City Council on November 19,2003 and amended on February 2,2005; and 2. That the City Council, at its meeting held February 2, 2005, adopted Resolution No. 2005-19 allowing the acceptance of public improvements for Legacy Estates, Unit 1, prior to the completion of the Harney Lane improvements and approved a new Improvement Agreement with DSS Company to cover the completion of the Harney Lane improvements: and 3.
