AGENDA TITLE: Adopt Resolution Approving Final Map for Kirst Estates No. 5, Tract No. 3459
MEETING DATE: January 5, 2005

RECOMMENDED ACTION: That the City Council adopt a resolution approving the final map for
Kirst Estates No. 5, Tract No. 3459, and direct the City Manager and
City Clerk to execute the map on behalf of the City.
BACKGROUND INFORMATION: The subdivision is located north of Harney Lane, immediately
adjacent to the Legacy Estates, Unit No. 2 development, as shown
on Exhibit A. The development consists of six low-density
single-family residential lots and Lot A that contains an existing
low-density single-family dwelling.
The developer, Daisy Enterprises, L. P., has furnished the City with the water rights agreement and paid
the fees, including Development Impact Mitigation Fees ($55,960.50), for the proposed subdivision. In
addition, the developer has obtained a building permit to connect the existing dwelling on Lot A to public
water and wastewater services, as required under the conditions of approval for the subdivision. The
public improvements for the subdivision are currently under construction as part of the adjacent
Legacy Estates, Unit No. 2, subdivision and are included in the plans, improvement security, insurance
and improvement agreement for that project approved by Council on September 1, 2004.

RESOLUTION NO. 2005-05
A RESOLUTION OF THE LODI CITY COUNCIL
APPROVING THE FINAL MAP FOR KIRST
ESTATES NO. 5, TRACT NO. 3459
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby
approve the Final Map for Kirst Estates No. 5, Tract No. 3459, located north of Harney
Lane, immediately adjacent to the Legacy Estates, Unit No. 2 development, as shown on
Exhibit A; and
BE IT FURTHER RESOLVED that the City Council hereby directs the City
Manager and City Clerk to execute the Final Map on behalf of the City of Lodi.
