COUNCIL COMMUNICATION
AGENDA TITLE: Set a Public Dearing for July 2, 2003, to consider the appeal of -REM regarding the
Planning Commission's denial of the request to amend Resolution 03-12 adding a
condition of approval to the Vintner's Square Shopping Center located at the
northwest comer of Lower Sacramento Road and Kettlernan Lane.

RECOMMENDED ACTION: That the City Council set a Public Hearing for July 2, 2003, to
consider the appeal of G -REM regarding the Planning
Commission's denial of the request to amend Resolution 3-12
adding a condition of approval to the Vintner's Square Slopping Center located at the northwest corner of
Lower Sacramento Road and Kettlernan lane.
BACKGROUND INFORMATION: Cin June 11, 2003, the Planning Commission denied the
applicant's request to add a condition of approval to the Vintner's
Square Shopping Center, Resolution 03-12. The applicant,
G -REM, is appealing this decision in order to have the City Council consider the merits of the request.
Further, the applicant is requesting the item be heard in conjunction with the appeal fled by Ann Cerney
and Citizens for Open Government that was filed against the Final EIR for the project. As such, staff is
making a separate recommendation regarding that item on your agenda.

The City Clerk's Office is in receipt of your correspondence regarding the above subject dated
June 12, 2003, which has DQen timely filed in accordance with Lodi Municipal Code 17.72.110.
This letter is to inform you that in addition to providing a copy to the City Council we have
forwarded your correspondence to the following departments for information, referral, or handling:
i) City Manager, 2) City Attorney, and 3) Community Development.
Your check in the amount of $250 to appeal the decision of the Planning Commission was
