AGENDA TITLE: Adopt Resolution Awarding Contract for the White Slough Water Pollution Control Facility
Aeration Blower Replacement to Hibon, Inc., of Quebec, ($222,000) and Authorizing Use of
Public Benefit Funds ($20,000); and Appropriate Funds

RECONI ENDED ACTION: That the City Council adopt a resolution awarding the contract for the above
project to Hibon, inc., of Quebec, Canada, in the amount of $222,000 and
authorizing use of Public Benefit Funds in the amount of $20,000; and appropriate
funds in accordance with the recommendation below.
BACKGROUND INFORMATION_ This project consists of replacing four 10+ -year-old aeration blowers, which
supply air to the facility's biological treatment process. The aeration blowers
are critical to plant performance and are in need of replacement to maintain
effluent quality, The four aeration blowers being replaced were installed
during the 1989 plant expansion.
As part of this bid, a guaranteed price quote for later purchase of the ancillary appurtenances was sought. This
quote was used ru choosing the lowest responsibie bidder, but the ancillary appurtenances will not be purchased at
this time. Hibon's bid of $179,300 foi- :he ancillary equipment was also the low bid. The appropriation requested
i3elow is for the blowers alone.
Plans and specifications for this project were approved on April 16, 2003. The City received the following three bids
for this project:

Details of variance from bidding procedure for the
Aeration Blower Replacement bid opened May 6,2003
The bid from Spencer Turbine was delivered by FedEx at 1:42 p.m. on May 6, 2003, 2 hours
and 4%minutes late for the 11:00 a.m. bid opening. Staff subsequently determined that the
delay was not the fault of the bidder, SpencerTurbine. FedEx was unable to fly in and out of
their Memphis hub on schedule because of severe weather conditions. We also determined
that the delay did not give the bidder an unfair advantage or benefit over the other bidders.
Further, court cases have established that such circumstances do not constitute a bidding
irregularity, and have allowed similar late bids to be accepted by the public agency. As a result,
the Purchasing Officer determined that the bid should be considered, and the bid was opened
on May '19.

WHEREAS, in answer to notice duly published in accordance with law and the order of this
City Council, sealed bids were received and publicly opened on May 6, 2003, at 11:00 a.m. for the
White Slough Water Pollution Control Facility Aeration Blower Replacement, described in the
specifications therefore approved by the City Council on April 16, 2003; and
WHEREAS, said bids have been compared, checked, and tabulated and a report thereof
filed with the City Manager as follows:
