Staff subsequently determined that the delay was not the fault of the bidder, SpencerTurbine. FedEx was unable to fly in and out of their Memphis hub on schedule because of severe weather conditions. We also determined that the delay did not give the bidder an unfair advantage or benefit over the other bidders. Further, court cases have established that such circumstances do not constitute a bidding irregularity, and have allowed similar late bids to be accepted by the public agency. As a result, the Purchasing Officer determined that the bid should be considered, and the bid was opened on May '19. (P CITY ODI COUNCIL COMMUNICATION 86LNDAT|TLE: Arlo p1Rosu|uUAwarding AormtiooBlower Replacement LnMioon.|nc.ofQuebec, ($222.VOV)and Authorizing Use of Public Benefit Funds ($2O.000);and Appropriate Funds MEETING DATE: May Z1.2VO3 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council adopt aresolution awarding the contract for the above project toHiboo.!nn..nyQuebec, Canada, inthe amount oy$222.8O0and authorizing use of Public Benefit Funds in the amount of $20,000; and appropriate funds in accordance with the recommendation below, BACKGROUND INFORMATION: This project consists of replacing four 10 -r -year-old aeration blowers, which supply air to the facility's biological treatment process.
