Adapt resolution authorizing the City Manager to execute an Agreeme"t with the firm of Liebert, Cassidy, and NWitmore to perform 8n audit of the City's compliance with the Fair Labor Standards Act (FLSA) (NTF,, $20,000) (HR), BACKGROUNDINFORMATION: In 1480, the FLSA becar e applicable to the public sector. Since this t.iT e the law leas c:hW ged, however, the City has not e. -valuated its compliance with this statute. 'The, proposed audit is necessary to ensure compliance with the legal requirements governing en-iployee work hours gaud overtime. Staff bclicve:s this is a critical issuc as undetected non-compliance could expose the City to substantial back ,pay liability and penalties. The audit would identify exempt job classes and those properly € overed by FLSA.. We are further requesting that: the firm of Liebert, Cassidy, and Whitmore be hired to perform this audit.
