Adopt a resolution to 1) reject the low bid for conduit fittings and award the bid in that category to the second -low bidder, Intraline, Inc., of Burlingame, and 2) award the bid for power utility conduit to the low bidder in that category, AZCO at Stockton, (Total: $32,554.30) (EUD) MEETING DATE, April 2, 2003 PREPARED BY, Electric Utility Director RECOMMENDED ACTION: That the City Council adopt a resolution rejecting the low bid for conduit fittings (couplings, elbows) submitted by All -Phase Electric Supply Company of Stockton, awarding the bid for fittings to the second -low bidder by virtue of payment terms offering a 2% discountifinvoice is paid within 20 days (Intraline, Inc. of Burlingame), and further awarding the bid for utility conduit to the low bidder in that category, AO of Stmkton. Total amount of award is $32,554.30, BACKGROUND INFORMATION'. On March 5, 2003, the City Councit approved specifications and authorized advertisement for bids for this material. Seven bids were received, and opened on March 19, 2003. Since prices for conduit and for fittings move somewhat independently of each other, bid specifications separated conduit and fittings into separate categories, and bid instructions indicated that award would be made to the low bidder in each categovy. Electric Supply, Stockton $ 5,486,85* $35231.90* *Alf-Phaso Electric's bid contained an exception to price protection, and is therefore considered non-responsive Although All -Phase Electric's bid for fittings was low, the bid contained an exception to specifications in that quoted prices were valid for only 19 days. Bid specifications require that prices be firm for thirty days. The 19 -day "firm" period requested by All -Phase may have given them an unfair pricing advantage over other bidders who complied with the 3.0 -day "firm" requirement , Staff therefore recommends that the bid from All -Phase Electric be considered non-responsive and be rejected, and that award for fittings be made to intraline, the next -low bidder in that category when their payment terms of 2% 20 days are considered in the bid evaluation. (Bid instructions indicate that terms offering a discount for payment in 20 days or more shall be considered in the evaluation.) Some of the subdivisions planned for service installation are Century Meadows #1 Units 2 and 3. Century Meadows #2 Unit 4, Century Meadows #3 Unit 4, Almondwood Estates, Legacy Estates, and Woodhaven #3. RESOLUTION NO. 2003 - WHEREAS, in answer to notice duly published in accordance with law and the order of this City Council, sealed bids were received and publicly opened on March 19, 2003, at 11:00 a.m. for peer utility duct and fittings, described in the specifications, therefore approved by the City Council on March 5, 2003, and WHEREAS, since prices for conduit and for fittings move somewhat independently of each other, bid specifications separated conduit and fittings into separate categories, and bid instructions indicated that award would be made to the low bidder in each category. NOW, THEREFORE, BE IT RESOLVED by the Lodi City Council that the bid for conduit fittings from All -Phase Electric Supply Company, of Stockton, California, i's hereby rejected, and the bid is hereby awarded to the next lowest bidder, Intraline Inc., of Burlingame, California, in the amount of $5,769.50; and BE IT FURTHER RESOLVED that the Lodi City Council hereby awards the bid for utility conduit to the low bidder in that category, A. O, of Stockton, California, in the amount of $26,784 80, Dated: April 2, 2003.
