AGENDA TITLE: Adopt Resolution Accepting Improvements at 1811 West Kettleman Lane

RECOMMENDED ACTION', That the City Council adopt a resolution accepting the improvements at
1811 West Kettle ma n Lane.
BACKGROUND INFORMATION: Improvements at 1811 West Kettleman Lane have been completed
in substantial conformance with the requftments of the
Improvement Agreement between the City of Lodi and
Darrell R. Sasaki, as approved by the City Manager on
October 8, 2002, and as shown on City of Lodi Drawings 0020021 and 0020022.
The improvements consist of water, sewer and storm drainage pipes extended from Tienda Drive
southerly approximately 200 feet. The purpose of the improvements is to provide public services to
properties that front on Kettlernan Lane but cannot be served from that street. The improvements have
been constructed, in part, to offset impacts of the future Kettleman Lane Gap Closure project that will
impact the Tsutaoka parcel,
As part of the parcel map filing that required these improvements, the owner of this parcel dedicated
additional tight -of -way on Kettleman Lane as part of the improvement agreement. The City will transfer
this strip of Kettleman Lane to Caltrans when the Kettleman Lane Gap Closure project is ready to be
constructed along this frontage.

The City Council of the City of Lodi finds;
1- That all requirements of the Improvement Agreement between the City of Lodi and
Darrell R. Sasaki, for the improvements at 1811 West Kettleman Line, have been sub tanti lly
complied with. The improvements are shown on Drawing Nos. 0020021 and 002DO22 on file in
the Public Works Department and as specifically set forth in the plans and specifications
approved by the City Manager on October 8, 2002.

The City Council of the City of Lodi, at its meeting on February 6, 2003, accepted the
pudic improvements that were made in the subject proiect,
Enclosed for your files is a copy of the resolution accepting the public improvements.
From the date of the resolution, the City of Lodi will maintain the strut and ether public
improvements installed within rights-of-way and public utility easements as shown can
the approved plans.
The Certificate of [deposit assigned to the City to guarantee faithful performance can
now be reassigned to you. The Certificate of Deposit guaranteeing labor and materials
will have to remain in effect for a period of ninety days from the date of the resolution in
conformance with State law.
