AGENDA ITEM Ew.17 CITY OF LODI %W COUNCIL COMMUNICATION TM AGENDA TITLE: Adopt Resolution Establishing and Updating Public Works Engineering Fees for Preparation of Agreements and Processing of improvement Projects MEETING DATE: December 17, 2003 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council adopt a resolution establishing and updating Public Works Engineering fees for preparation of agreements and processing of improvement projects BACKGROUND INFORMATION: Council approved the current schedule of Public Works Engineering and miscellaneous fees in April 1999, and they took effect July 1, 1999. These discretionary services are typically funded in whole or in part by userfees. The proposed fee adjustments (Exhibit A) are based largely upon salary increases over the past four years, resulting from cost of living adjustments and salary survey adjustments. Several fees are comparable to the fees charged by the County and cities in the County. Fees included in this category are Plan Check, Inspection, and Improvement Agreements. A comparison of these fees for Lodi, Stockton, San Joaquin County, Tracy and Ripon is presented in Exhibit B. At the proposed schedule, Lodi fees will remain modestly below the surveyed agencies. Three new fees are recommended by staff and these are: 1) Improvement Agreement, 2) Improvement Agreement Addendum, and 3) Deferred Improvement Agreement. Over time, the breadth, scope and complexity of these agreements has grown to a level where the costs cannot reasonably be absorbed by the City. In other San Joaquin County cities, these discretionary services are charged in addition to the plan check charges for improvement projects. The fee for lot line adjustments is substantially higher than before, based on the level of effort and the fact that the original fee which was initiated in 1999 was underestimated. An annual adjustment formula based upon the Consumer Price Index (Western Region, Urban, unadjusted) is included in the fee schedule that applies to all fees except Plan Check and Inspection, as these are based on a percentage of construction costs. There was no adjustment clause in the prior fee schedule. As a result, the noted fees in Exhibit A will automatically increase on July 1 of each year. FUNDING: Not applicable. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lodi does hereby implement the fee schedules as attached hereto and made a pari of this Resolution. All resolutions or parts of resolutions in conflict herewith are repealed insofar as such conflict may exist.
