Stephens Construction Company, of Lodi ($266,680); and Appropriate $320,000 for the Project MEETING DATE: December 17, 2003 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council adopt a resolution awarding the contract for the above project to A.M. Stephens Construction Company of Lodi, in the amount of $266,678.00; and appropriate funds in accordance with the recommendation shown below. BACKGROUND INFORMATION: This project will develop the storm drainage storage portion of DeBenedetti Park. This first phase of the park development consists of the excavation, rough grading and export of material from the DeBenedetti Park site. The work also includes site fencing, mowstrips, rip -rap, and other drainage -related work. Approximately 324,000 cubic yards of dirt must be excavated, with approximately 234,400 cubic yards of that excavated material being exported off the site. The excavation/grading of this park will provide storm drainage detention storage for the area north of Harney Lane, bounded by Lower Sacramento Road on the west and the Woodbridge Irrigation Canal on the east and north. In order to reduce the excavation costs, this rough grading contractor is being given a total of four years to complete the excavation and rough grading. However, the portion adjacent to the major sports facilities is required to be completed in two years (Zone 1). The intent is to have the contractor excavate the basin as the need for dirt in the area arises so that the contractor won't have to stockpile and double -handle the dirt. In fact, with this method, the low bidder is actually paying the City for the dirt, thus offsetting approximately $100,000 worth of site work. (See attached bid tabulation.) The City's "standard" procedure is to require a bid bond in the amount of 10% of the bid proposal. However, since there was a possibility that the City would receive bids wherein the contractor would pay the City to excavate the basin area, the specifications established a set bid bond amount of $100,000. A.M. Stephens Construction, the low bidder, and two other bidders did not include a bid bond of at least $100,000. Their bid proposals included a standard 10% bid bond. The day after the bid opening, A.M. Stephens provided the City with a $100,000 bid bond. As A.M. Stephens did not receive any significant bid advantage in omitting the $100,000 bid bond on the day of the bid opening, staff is recommending that Council waive this informality and award the DeBenedetti Park/G-Basin Rough Grading contract to A.M. Stephens. Plans and specifications for this project were approved on August 20, 2003. Woodbridge $2,322,630.00 The park design includes a sufficient amount of "high ground" outside the grading area in this contract. During the time frame of this contract, staff anticipates having other contracts for the installation of underground utilities and, hopefully, a start on the actual park improvements. These may require change orders on this contract to accommodate this work, thus we are recommending a higher -than -normal contingency amount (20%) in the project appropriation. Staff also intends to eliminate the block wall on the east side of the deep basin and use chain link fence as a cost-saving measure (see site map).
