BACKGROUND INFORMATION: On July 2, 2003, the City Council adopted Resolution 2003-109 awarding contracts to the evaluated low bidder in each of five categories of the electric utility overhead and underground distribution hardware supply agreement, covering the two-year period ending June 30, 2005. Agreements were signed by all awardees except Graybar Electric. Repeated attempts by city staff to secure a signed contract were met with excuses from Graybar as to reasons for the delays. Staff now believes Graybar has no intention of honoring their bid or signing the contract. It is therefore recommended that the contract for Category 2 to Graybar Electric be rescinded, and that Category 2 be awarded to the second -low bidder, Southwest Power. The anticipated additional two-year cost to award to Southwest Power is $2,103.30. FUNDING: Electric Utility Department's 2003-2005 Fiscal Operating Plan VickyMcAthlnce Director Alan N.
