AGENDA TITLE: Approve the Improvement Agreement for the Public Improvements for 4349
1333 East Kettleman Lane and Appropriate Funds for the Required Reimbursements ($261,500)

RECOMMENDED ACTION: That the City Council approve the Improvement Agreement for the public
improvements for 43491333 East Kettleman Lane, direct the City Manager and
City Clerk to execute the Agreement on behalf of the City, and appropriate funds
for the required reimbursements. (Address changed per owner's request)
BACKGROUND INFORMATION: The project consists of public street and underground utility improvements
required for the construction of a car dealership at 4349
1333 East Kettleman Lane. The project site is north of Kettleman Lane and
east of Beckman Road, as shown on Exhibit A.
The Developer has furnished the City with improvement plans, necessary agreements, guarantees and insurance
certificate for the proposed project.
The improvements include the installation of a master plan storm drain line in Kettleman Lane and Auto Center Drive,
and installation of master plan water mains in Kettleman Lane, Pixley Parkway, and Auto Center Drive, as well as
street pavement improvements on Kettleman Lane. The developer is also entitled to reimbursement by the City for
the installation of master plan storm drain facilities, excess width street pavement improvements in Kettleman Lane,
and oversize water mains in conformance with LMC 15.64 Development Impact Mitigation Fees and
16.40 Reimbursements for Construction. All reimbursements wilt be made when the improvements are complete and
accepted by the City.
Staff requests the appropriation of the funds listed below to cover the reimbursements to be paid by the City to the
developer.
