8ACK3R3UND|NR]RMATON� As a conditionof approvalR7 the final pame hadivide the former known
as 1811 West Kettleman Lane into three parcels and allow development on the newly
created parcel now known as 1816 Tienda Drive, the Applicant, Darrell R, Sasaki,
was required to construct public improvements to serve existing and proposed
parcels south ofApplicant's project site, Applicant entered into anImprovement Agreement with the City on
October O.2OO2.iuconstruct the required pub|icimprovements. The terms mfthe Improvement Agreement required the
installation of water main and storm drainage lines, as well as other miscellaneous and related improvements along the
west boundary of Applicant's parcel to serve the neighboring properties known as APN 031 040-20, owned by
TnuiomuTsutmoha,and APN031-040-4U`owned byJohn Bezug. The benefiting properties are shown onExhibit A.
The Applicant has requested aReimbursement Agreement and establishment ofmnarea nfbenefit inconformance
with Chapter 16 40 of the Lodi Municipal Code for those improvements that benefit the neighboring properties,
The property owners within the area ofbenefit have been notified. The Applicant has paid the appropriate application
fee and the fees tocover the cost ofrecording the Reimbursement Agreement. Acopy ofthe itemized costs for the
reimburamble|mpromamentaioattached as Exhibit B.

benefit and reimbursable costs to recover the cost of public improvements benefiting the parcels known as
APNO31'040'2Uand APNO30-040-40, The reimbursable costs for each property are shown onExhibitB.
Pufsuani to Lodi Municipail Code Section 16,40.50.A.3, the reimbursable amount shallbe recalculated annually to
include anannouniattributable tointerest, using the Engineering News Record (ENR)20Cities Construction Cost
Index, Similar adjustments to the reimbursable costs will be made each January until payment is received. In the
event that the benefiting properties shown on Exhibit A develop, the City will collect the appropriate amounts from the
daveioperaofthe benefiting property and reimhuroothe Applicant. The charges for nbenefiting property shall b*paid
m full at the time ofthe first development on that property,

Enclosed is a copy of background information on an item on the City Council agenda of
Wednesday, October 1, 2003. The meeting will be held at 7 p.m. in the
City Council Chamber, Carnegie Forum, 305 West Pine Street.
As indicated in the title, the only action will be to set a public hearing date on the item.
Public hearings are usually set for the second following Council Meeting.

mail. Or, you may hand -deliver the letter to City Hall, 221 West Pine Street.

NOTICE IS HEREBY GIVEN that on Wednesday, November 5, 2003 at the hour of 7:00 p.m., or as soon
thereafter as the matter may be heard, the City Council will conduct a Public Hearing at the Carnegie Forum,
305 West Pine Street, Lodi, to consider the following matter:
a) Reimbursement Agreement RA -03-03 establishing an area of benefit and reimbursable costs for
public improvements for 1816 Tienda Drive, APN 031-040-39 (a portion of the former parcel known
as 1811 West Kettleman Lane)
Information regarding this item may be obtained in the office of the Public Works Department Director, 221
West Pine Street, Lodi, California. All interested persons are invited to present their views and comments on
this matter. Written statements may be filed with the City Clerk at any time prior to the hearing scheduled
herein, and oral statements may be made at said hearing.
If you challenge the subject matter in court, you may be limited to raising only those issues you or someone
else raised at the Public Hearing described in this notice or in written correspondence delivered to the City
