AGENDA TITLE. Approve Improvement Deferral Agreement for 2113 Cochran Road

RECOMMENDED ACTION.- That the City Council approve the Improvement Deferral Agreement for
2113 Cochran Road and authorize the City Manager and City Clerk to
execute the agreement on behalf of the City,
BACKGROUND INFORMATION: The owner of the property, David C. Rodgers, has submitted a final
parcel map to create two parcels from one parcel on the north side
of Cochran Road, as shown on Exhibit A.
Installation of street frontage improvements, including curb, gutter, sidewalk, street paving and street
lights, is required as a condition of the tentative map conditions (Resolution No. P.O. 02-25). Since
there are currently no street frontage improvements on adjacent parcels on Cochran Road, the owner
has requested a deferral for such improvements. Staff feels that this is a reasonable request.
The owner has signed an Improvement Deferral Agreement and paid the necessary recording fees for
the agreement. The agreement, in part, states that the owner will pay for and complete the design and
installation of the required improvements at the time of installation of such improvements on adjacent
parcels, or at the request of the City, whichever occurs first.
Staff recommends approval of the Improvement Deferral Agreement.
