AGENDA TITLE: Adopt Resolution Rejecting Bid from George Reed, Inc., and Awarding Contract for
2003 Handicap Ramp Retrofit Project to A.M. Stephens Construction Company, of
Lodi ($279,920); and Appropriate $375,000 for the Project

RECOMMENDED ACTION: That the City Council adopt a resolution rejecting the bid from
George Reed, Inc., and awarding the cont ractfor the above project to
A.M. Stephens Construction Company, of Lodi, in the amount of
$279,919.00; and appropriate funds in accordance with the
recommendation shown below.
BACKGROUND INFORMATION: This project will provide the City with a unit -price based bid for
removing and replacing curb, gutter and sidewalk at various
locations throughout the city and installing handicap ramps to meet
the requirements of the Americans with Disabilities Act (ADA). This
will be an annual contract and Community Development Block Grant (CDBG) funds will be used to
implement the, Handicap Ramp Retrofit. Program during 2003 and 2044. The bid proposa4 tota4 of
$279,919 was used as a basis for the award of the contract. Purchase orders for individual projects will
be Issued using the unit -price bids until the CDBG funds ($375,000) are expended.
George Reed, Inc., was the apparent lorry bidder at the time of the bid opening. However, their bid
proposal did not include the Addendum 2 information which increased the quantity for the "Install Curb
and Gutter" bid item. George Reed, Inc,, would not have been the low bidder had they used their same
"Install Curb and Grater" unit price with the Addendum 2 quantity. Staff is recommending that
George Reed's bid be rejected as non-responsive and the 2003 Handicap Ramp Retrofit Project be
awarded to A.M. Stephens Construction Company.
Mans and specifications for this project were approved on May 31, 2003. The City received the
following five bids for this project:

RESOLUTION NO. 2003-138
A RESOLUTION OF THE LODI CITY COUNCIL REJECTING
THE APPARENT LOW BID AND AWARDING THE BID FOR THE
2003 HANDICAP RAMP RETROFIT PROJECT, AND FURTHER
APPROPRIATING FUNDS TO COVER THIS PROJECT
WHEREAS, in answer to notice duly published in accordance with law and the order of
this City Council, sealed bids were received and publicly opened on July 2, 2003, at 11:00 a.m.
for the 2003 Handicap Ramp Retrofit Project, described in the specifications therefore approved
by the City Council on May 31, 2003; and
WHEREAS, said bids have been compared, checked, and tabulated and a report
thereof filed with the City Manager as follows:

WHEREAS, staff recommends rejecting the bid from George Reed, Inc., for the reason
stated above, and further recommends awarding the bid for the 2003 Handicap Ramp Retrofit
Project to the lowest responsible bidder, A.M. Stephens Construction Company, of Lodi, CA.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council hereby rejects the
non-responsive bid from George Reed, Inc., of Lodi, CA, and further awards the bid for the
2003 Handicap Ramp Retrofit Project to A. M. Stephens Construction Company, of Lodi, CA,
the low bidder, in the amount of $279,919.00; and
BE IT FURTHER RESOLVED, that the City Council hereby appropriates funds for this
project as follows: 2002 CDBG Fund $200,000.00
2003 CDBG Fund $175,000.00
