BACKGROUND INFORMATION: This item appears on the agenda as requested by Mayor Hitchcock. The City Clerk's Office has distributed a survey to California cities asking how many cities have a residency requirement for city board and commission members and what those requirements are. Results of this survey will be compiled and presented to the City Council at the meeting. FUNDING: None required. �Blon City Clerk SJB/JMP Prepared by Jennifer M. Perrin, Deputy City Clerk Below is a tabulation of the responses from a listserve email survey sent to California city clerks' offices, which asked whether their city's boards and commissions had a residency requirement. SUMMARY`. ➢ Total number of YES answers: 61 Of the YES responses 18 have a requirement for city residency AND being a registered voter ➢ Total number of NO answers: 6 ➢ Total number of OTHER answers: 6 ➢ TOTAL number of responses: 73 NAME OF CITY # OF B/C RESIDENCY REQUIREMENT? YES NO/OTHER Adelanto 2 YES. Albany YES for all; however, the only exception is an ad hoc committee, on which business owners serve. Anaheim 13 YES. Atascadero 2 YES; language in municipal code stating all commissioners shall be residents of the city. Additionally, resolution states all commissioners shall be residents of the city and registered to vote in the city. Burbank 22 YES; code requires that b/c members be electors and residents of the city. California City 3 NO. Carlsbad 14 YES; requires that applicants to an b/c be city residents. Chula Vista 25 YES; all members of b/c shall be qualified electors in the city with the exception of YC who need only be residents of the city. The council may appoint non -electors to those b/c that are advisory only and whose duties involve regional issues. Appointment of non - electors must be passed by at least four affirmative votes. No person may be appointed nor shall serve on more than one of the charter -created b/c simultaneously. Cupertino 11 YES; most have a residency requirement; however, some of them allow one or two members to be outside the city. Delmar 3 b/c YES; all b/c members are 10 required to be residents of advisory the city. Of the ten advisory comm. committees, nine require only residents, and the other committee (five members) allows that one member does not have to be a resident. Downey 15 YES, charter requires them to be voters, and most of them must live in the respective district (council is elected by district and appoints their b/c members by district with two exceptions). EI Cajon 10 YES. Emeryville OTHER; requirement is to reside, own a business, or work in the city, but residents have priority. Fairfax 2 boards YES, require that all 2 comm. appointees be residents. Folsom 10 YES, charter requires that members of these boards be residents and registered voters of the city. Fort Bragg 3 OTHER; residents of the city and persons owning a business or commercial property shall be given preference for appointment to advisory committees. Fremont 14 YES, on a couple of the b/c residency is waived when one of the members is an appointee of another agency. Gilroy 6 comm. YES; per the charter, must be 2 boards registered voters within the city limits (except for the YC, which must live within the Gilroy Unified School District). Grass Valley 6 NO. Hillsborough 4 YES; residency is required. Irvine 5 YES. La Canada Flintridge 7 YES. Laguna Hills 2 YES; not only residency, but must be registered voters. Larkspur 4 YES. Lawndale 3 comm. YES; has 30 -day residency 3 com. requirement for all but two one board positions: Community Watch Committee (appointees must be in business or employed by a business in the city) and Personnel Board (it is preferred, but not required, to have some sort of human resources experience). Lomita 6 YES for all but the Museum Foundation Board. Martinez 8 YES, except for Veterans Comm. and Marina Comm. Residence or employment within the corporate limits of the city shall be requisite for membership on the Veterans Commission. For the Marina Commission: one selected by Yacht Club; one who berths a vessel at the marina; one who is user of the Launch Ramp facility; one who regularly does business with the marina; one who lives in the city; member of Rec.; and one selected by the East Bay Regional Park District. Mill Valley 5 OTHER; PC must be residents of the city; Rec. (seven members) one may live outside city limits, but within school district boundaries/sphere of influence; Emergency Preparedness (same), Library Board (five members) one may live outside city limits; Arts Commission (seven members) three may live outside city limits, but within the sphere of influence. This way the unincorporated areas are represented, but decisions about city programs and services are made by the people who pay for them. Page 4 of 7 Modesto YES, with the exception of the PC and Board of Zoning Adjustment. Monrovia 5 NO, with the exception of the Historic Preservation Commission; consideration will be given to include this requirement on all others except the Monrovia Old Town Advisory Board. Moreno Valley 2 boards YES. one comm. 6 com. Mountain View 8 YES for all, except the Bicycle/Pedestrian Advisory Committee, Downtown Committee, and Performing Arts Advisory Committee. Murrieta 5 YES, requirements are: a resident (not necessarily a citizen) of Murrieta, 18 years old and NOT a city employee. There is an exception to the residency requirement for someone who represents an entity, i.e. the school district. Napa 21 YES; must be a full-time resident and registered voter of the city. Oxnard 11 YES, with the exception of the Homeless Task Force does not, nor does the Downtown Design Review Committee because it has specific requirements for architects. Palm Springs 14 YES; Must be a registered voter in the city. Pico Rivera 2 comm. OTHER; only the PC and the various Community Resources com. Advisory Comm. require city residency. Placerville YES; must reside within the city limits or own or operate a business within the city limits. Pleasanton 11 YES, except for Economic Vitality where there would be a city business owner requirement. Pomona 7 YES; must be a resident of the city. Page 5 of 7 Rancho Mirage 11 YES, but residency requirements vary and relate to the nature of the comm. Each time a comm. is established, residency requirements are addressed so there is no hard fast rule for whether city residency is required or not. Most do; those that do not are of a broad nature (e.g. Community Trails Comm. with no residency requirement; the architectural review board with no residency requirement, but requires two licensed architects; etc. Red Bluff 4 NO. Redding 6 NO; members must either own a business or be employe in the city. Redlands 16 YES; all have a residency requirement except the Downtown Redlands Business Association Board who shall own a business within its boundaries. Redondo Beach 17 YES; requires all b/c members to be registered voters of the city. Ridgecrest 2 YES; B/C members shall be registered voters within the city and appointed based on their qualifications for their duties. Rio Vista 4 YES, all but the Airport Advisory Comm. The two exceptions only state that board members should either reside or work within the city. San Gabriel 4 YES; city residency is required for all except the Design Review as the requirement is for certain professionals to serve. San Juan Bautista 2 YES. San Juan Capistrano 8 YES. Santa Clara 10 YES; must be a registered voter in the city. Santa Maria 8 YES, and some, such as PC and Rec., require applicants to be registered voters of the city. Others, which are broader in scope, do not, such as the Block Grants Advisory Committee and the All America City Committee. Saratoga 8 comm. YES; must be a resident and various a registered voter in the city. ad hocs & com. Scotts Valley 8 YES; has city limit residency requirements for PC and residency requirements within the City's planning area for all others. Stockton YES; most b/c have a residency requirement that members must reside within the city limits. Tracy 12 YES; each b/c has its own bylaws that state residency requirement. Turlock 3 YES; PC must live within the city limits; Rec. must live within the city's defined recreational district, which encompasses some outlying areas at the edge of the city limits; Arts (25 member comm.) 15 must live in the city limits and no more than 10 may reside outside of the city limits, but must live within boundaries of the Turlock Irrigation District or Stanislaus County. Union City 5 YES; must be a U.S. citizen and a resident of the city. Page 7 of 7 Walnut Creek 5 YES; must be city resident except for the architect and landscape architect positions on the Design Review Commission and three seats on the Arts Commission. West Sacramento 9 YES. Westminster 15 OTHER; some have residency requirements; others do not. Whittier 10 YES; per the city charter, members must be registered voters of the city. Winters 4 YES. Woodland 12 YES; must be a registered voter and reside within the city limits. Yountville YES; requirement is that members live in and are registered voters of the town; however, that requirement can be waived by the council if the applicant has special knowledge or experience in whatever field the committee covers.
