AGENDA TITLE: Adopt Resolution Rejecting All Bids, Approving Revised Specifications, and Authorizing
Advertisement for Bids for Sidewalk Repair Program and Miscellaneous Repair Program, Fiscal
Year 2003/04, and Further Authorizing the City Manager to Award or Reject the Contract up to
$38,000

RECOMMENDED ACTION-, That the City Council adopt a resolution rejecting all bids, approving the revised
specifications for the above project, authorizing advertisement for bids, and further
authorizing the City !Manager to award or reject the contract up to $38,000
BACKGROUND INFORMATION: The specifications provide for the placing of concrete at various locations within
the City. Concrete placement includes removal of curb, gutter, and sidewalk
with all removal performed by City forces.
Specifications for this activity were approved on April 16, 2003, with the adoption of Resolution No. 2003-56. The
City received the following bids for this project:

Funds ($30,000) have been appropriated in the 2003/2004 Financial Plan and Budget. In the past, costs fr r th.e
annual sidewalk repair program included removal of the concrete. In a cost-saving effort, the removal of concrete
was eliminated from the contract with all removal work to be performed by City forces. Removal has been an
integral part of the contractor's bid, allowing for a reduced cost for concrete installation. This resulted in a higher
cost of installation, Since the bid was higher than the Engineer's Estimate, the specifications have been revised to
eliminate items and reduce quantities in order to get costs down to the allocated amount. The amount of $38,000 is
to allow for any unforeseen increase in costs due to the smaller quantities, which can be adjusted down by contract
change order, The revised specifications are on file in the Public Works Department.
Staff requests that Council authorize the City Manager to award or reject the project up to $38,000.

(Page D-13, Summary of Significant Expenditures and Staffing Changes, 105031 Account)

RESOLUTION NO. 2003-122
A RESOLUTION OF THE LODI CITY COUNCIL REJECTING ALL BIDS,
APPROVING THE REVISED SPECIFICATIONS, AND AUTHORIZING
ADVERTISEMENT FOR BIDS FOR SIDEWALK REPAIR PROGRAM
AND MISCELLANEOUS REPAIR PROGRAM, FISCAL YEAR 2003-04;
AND FURTHER AUTHORIZING THE CITY MANAGER TO AWARD OR
REJECT THE CONTRACT UP TO $38,000.00
WHEREAS, in answer to notice duly published in accordance with law and the
order of this City Council, sealed bids were received and publicly opened on June 17,
2003, at 11:00 a.m. for Sidewalk Repair Program and Miscellaneous Repair Program,
Fiscal Year 2003-04, described in the specifications, therefore approved by the City
Council on April 16, 2003; and
WHEREAS, said bids have been compared, checked, and tabulated and a report
thereof filed with the City Manager as follows:

WHEREAS, in a cost-saving effort, the removal of concrete was eliminated from
the contract with all removal work to be performed by City forces. Removal has been an

This resulted in a higher cost of installation; and
WHEREAS, because the bids submitted were higher than the engineer's
estimate, staff recommends rejecting the bids and re -advertising with revised
specifications eliminating items and reducing quantities; and
WHEREAS, staff recommends that the City Manager be authorized to award or
reject the contract up to $38,000.00.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council hereby rejects
the bids for Sidewalk Repair Program and Miscellaneous Repair Program, Fiscal Year
2003-04; and
BE IT FURTHER RESOLVED that the Lodi City Council hereby approves the
revised specifications and authorizes advertisement for bids for the Sidewalk Repair
Program and Miscellaneous Repair Program, Fiscal Year 2003-04; and further
authorizes the City Manager to award or reject the bid up to $38,000.00.
