COUNCIL COMMUNICATION TM AGENDA TITLE: Adopt Resolution Accepting Development Improvements at 312 and 316 South Sacramento Street MEETING DATE: April 21, 2004 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council adopt a resolution accepting the development improvements at 312 and 316 South Sacramento Street. BACKGROUND INFORMATION: Improvements at 312 and 316 South Sacramento Street have been completed in substantial conformance with the requirements of the Improvement Agreement between the City of Lodi and Vic Meyers, Inc., as approved by the City Council on January 7, 2004, and as shown on Drawing No. 003D058-01. Dedication of street right-of-way and installation of street improvements along the Sacramento Street street frontage were required as a condition of the building permit issuance. Since the developer replaced the majority of the curb, gutter and sidewalk fronting the subject's parcels, staff received Council approval to have Vic Meyers, Inc., widen the east side of Sacramento Street from the northerly boundary of the developer's property to Lodi Avenue. Upon acceptance of this project, the City will reimburse Vic Meyers, Inc., for the cost of the street improvements north of 312 South Sacramento Street. This reimbursement cost is $10,106.98. The improvements are shown on Drawing No. 003D058-01 on file in the Public Works Department and as specifically set forth in the plans and specifications approved by the City Council on January 7, 2004. Public Works Director The City Council of the City of Lodi, at its meeting on April 21, 2004, accepted the public improvements in the subject project. A copy of the resolution is enclosed for your files. This letter is your authorization to exonerate the portion of the Instrument of Credit covering faithful performance, in the amount of $20,506.98. The portion of the Instrument of Credit covering labor and materials ($10,253.49) must remain in effect until July 20, 2004, in conformance with State law. You will receive no further correspondence regarding the release of the Instrument of Credit. Enclosed for your files is a copy of the resolution accepting the public improvements. From the date of the resolution, the City of Lodi will maintain the street and other public improvements installed within rights-of-way and public utility easements as shown on the approved plans. The enclosed letter has been sent to your bank so the Instrument of Credit covering faithful performance can be exonerated. The Instrument of Credit covering labor and materials must remain in effect for a period of ninety days from the date of the resolution, in conformance with State law.
