RECOMMENDED ACTION: That the City Council reschedule the public hearing to consider
adopting a resolution adjusting water/wastewater and refuse rates
from April 7, 2004 to a Special City Council meeting on Tuesday,
April 27, 2004 at 7:00 p.m.
BACKGROUND INFORMATION: Staff is recommending that the scheduled public hearing on the
proposed rate increases be moved to a later date and held at a
Special City Council meeting for the reasons described below:
The extension in time is required in order to meet a 45 -day notice period as part of the Proposition 218
process which our interim City Attorneys are recommending that we follow. This process includes a
mailed notice which will go out during this week, if the Council approves this action,
The notice also includes a statement that the rates may be raised in subsequent years in an amount up
To the percentage increase in the Consumer Price Index. This was included in order to give Council the
opportunity to include this in the rates resolution, should you choose to do so, This concept has. been
suggested at various firnes and was discussed at the previous Council meeting when other rate issues
were discussed. Also note that the attached rate tables are being provided with the notice, The Council
would have the ability to adopt these rates or a lower amount.
The reasons for a special meeting are two -fold. The regular meetings toward the end of the fiscal year
are often very busy with budget issues, and since this matter affects our three major rates, staff feels it
should be addressed separately to allow adequate public input. Also, the wastewater financing for the
critical White Slough Improvements needs to be in place when we award the contract, and action on the
rates is required in order to accomplish this. Waiting until later in May would cause numerous
repercussions for the project and the financing,

Notice of Proposed Increases to Monthly Water, Sewer and Refuse Rates and Charges
The City of Lodi proposes to,increase its monthly water, sewer and refuse rates and charges for residential,
connziercial and industrial users. It is currently proposed that the increases take effect beginning May 1, 2004.
The proposed charges are shown on the enclosed charts. In addition, all rates may be increased by an amount up
to the percentage increase in the Consumer Price index on July 1, 2005, and each following year as needed to pay
for increased costs of providing water, sewer and refuse services.
Proposition 218 requires that the City provide a notice of the proposed rate schedule to all property owners
forty-five (45) days prior to holding a public hearing. In order for the increase to "not take effect", a majority of
the property owners (not renters) are required to file opposition to the increase.
Property owners may file a written and signed protest against the proposed increases with the City Clerk at or
Wore the close of the public hearing. A protest must contain a description of the property owned sufficient to
identify the property. (The address or assessor's parcel number shown on this. mailing is sufficient.) If you awn
more than one parcel, you may file a single protest but it must identify each parcel you own. If the name on the
written protest is not shown on the last equalized assessment roll of San Joaquin County as the owner of the
property, the signer of the protest must also submit written evidence of ownership. At the public hearing, Council

Water - to provide funding for purchase of surface water to reduce groundwater overdraft, system replacement
and improvements, operations and maintenance and administrative and legal expenses related to the water
system. The proposed flat rates for each classification of property are determined by the estimated cost of
providing water service to customers in that classification based upon the water use characteristics of such
property. The proposed metered rates are detennined by increasing each classification the same percentage
increase as the residential.
• Sewer - to provide funding for improvements to the wastewater treatment facility to meet State discharge
requirements, system replacement and improvements, operations and maintenance, and administrative and
legal expenses related to the wastewater system. The proposed flat rates 'for each classification. of property are
determined by the estimated cost of providing wastewater collection and treatment service to customers in
that classification based upon the wastewater generation characteristics of such property.
0 Refuse — to provide funding for refuse collection and disposal and related expenses per the City's franchise
agreement, including increased fees for landfill disposal. The proposed flat rates for each classification of
property are determined by the estimated cost of providing refuse collection and disposal service to customers
in that service classification based upon the volume and frequency of service to the property.

RESOLUTION OF THE COUNCIL OF THE CITY OF LODI ESTABLISHING
WATER SUPPLY, WASTEWATER DISPOSAL AND REFUSE COLLECTION
SERVICE RATES
WHEREAS, the Council of the City of Lodi finds as follows:
1. The City of Lodi provides water supply, wastewater disposal, and refuse collection
services to its citizens;
2. The City charges customers of these utilities a charge to fund the on-going operation
And maintenance of the water supply, wastewater disposal, and refuse collection services;
3. The City Public Works Director and staff have prepared a plan outlining the costs of
operating these utilities, and the City Public Works Director has recommended increases to the
current water, wastewater disposal, and refuse collection rates;
4. The Council directed that notice of a hearing thereon be given to the property
owners in the City, with such notice to include, among other matters, the information required
to be included pursuant to California law;
5. Such notice has been mailed to those property owners, at least 45 days before the
hearing, as evidenced by a Certificate of Mailing on file with the City Clerk;
6. The Council also directed that notice of a hearing thereon be given with such notice
to include the information required to be included pursuant to Government Code
section 54354.5;
7. Such notice has been published once each week for two weeks, in accordance with
Government Code section 54354.5, in the Lodi News -Sentinel as evidenced by Proofs of
Publication on file with the City Clerk;
8. On April 27, 2004 the City Council conducted said public hearing at which time the
City Council heard all objections and protests to the proposed increased rates;
9. Written protests against the proposed increased rates were not presented by a majority
of the property owners; and
10. The proposed water, wastewater disposal, and refuse collection service rates are not
discriminatory or excessive, are sufficient under Government Code section 54515, comply with
the provisions or covenants of any outstanding revenue bonds of the City payable from the

revenues of the respective enterprise, comply with the provisions of Title 5, Division 2, Chapter
6 of the Government Code, and are in compliance with all other applicable law.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Lodi, that
Section 1. Recitals. The foregoing recitals are true and correct.
Section 2. Levy of Charges. Pursuant to Sections 13.08.010, 13.12.240, and
13.16.110 of the Lodi Municipal Code, the increased water, wastewater disposal, and refuse
collection service rates as attached hereto as Exhibits "A, B & C" are hereby approved.
Section 3. Subsequent Adjustments. The rates shown in Exhibits A, B, & C may
be adjusted periodically by resolution in an amount not to exceed the percentage change in the
Consumer Price Index since the previous adjustment. The index used shall be the unadjusted
San Francisco — All Urban Consumers Index as published by the United States Bureau of Labor
Statistics or other index as a,pproved by the City Council by resolution.
Section 4. Effective Date. This resolution shall take effect from and ager the
date of its passage.

Notice of Proposer! Increases to Monthly Water, Sewer and Refuse Rates and Charges
The City of Lodi proposes to increase its monthly water, sewer and refuse rates and charges for residential,
commercial and industrial users. It is currently proposed that the increases take effect beginning May 1, 2004.
The proposed charges are shown on the enclosed charts. In addition, all rates may be increased by an amount up
to the percentage increase in the Consumer Price Index on July 1, 2005, and each following year as needed to pay
for increased costs of providing water, sewer and refuse services.
Proposition 218 requires that the City provide a notice of the proposed rate schedule to all property owners
forty-five (45) days prior to holding a public hearing. In order for the increase to "not take effect", a majority of
the property owners (not renters) are required to file opposition to the increase.
Property owners may file a written and signed protest against the proposed increases with the City Clerk at or
before the close of the public hearing. A protest must contain a description of the property owned sufficient to
identify tl* property. (The address or assessor's parcel number shown on this mailing is sufficient.) If you own
more than one parcel, you may file a single protest but it must identify each parcel you own. If the name on the
written pr*test is not shown on the last equalized assessment roll of San Joaquin County as the owner of the
