AGENDA TITLE: Acceptance of Improvements for Sunwest Unit No. 11, Located at the
Southeast Corner of Lower Sacramento Road and Vine Street
MEETING DATE: April 3, 1991

RECOMMENDED ACTION: That the City Council adopt the attached resolution accepting
the development improvements for Sunwest Unit No. 11.
BACKGROUND INFORMATION: Improvements at Sunwest Unit No. 11 have been completed in
substantial conformance with the requirements of the
Development Agreement between the City of Lodi and Lodi
Sunwest Senior Project, dated November 29, 1989, as
shown on Drawing Nos. 89DO45, 89DO48, 890049, 89DO96, 89DO97, and 89DO98, and as
specifically set forth in the plans and specifications approved by the City Council.
The streets to be accepted are as follows:

Cologne Court 0.08
TOTAL NEW MILES OF CITY STREETS 0.08
FUNDING: None required.

A RESOLUTION OF THE LODI CITY COUNCIL
ACCEPTING THE DEVELOPMENT IMPROVEMENTS INCLUDED IN THE DEVELOPMENT
AGREEMENT FOR SUNWEST NO. 11, LOCATED AT THE SOUTHEAST CORNER
OF LOWER SACRAMENTO ROAD AND VINE STREET
The City Council of the City of Lodi finds:
1. That all requirements of the Development Agreement between the
City of Lodi and Lodi Sunwest Senior Project dated November
29, 1989, for the development improvements in Sunwest No. 11,
located at the Southeast corner of Lower Sacramento Road and Vine
Street, have been substantially complied with. The improvements
are shown on Drawing Nos. 89D045, 89DO48, 89DO49, 89D096,
890097, and 89DO98 on file in the Public Works Department.
2. The streets to be accepted are:

TOTAL NEW MILES OF CITY STREETS 0.08 miles

I hereby certify that Resolution No. 91-68 was passed and
adopted by the City Council of the City of Lodi in a regular meeting
held April 3, 1991 by the following vote:

The City Council of the City of Lodi, at its meeting on April 3, 1991,
accepted the offsite subdivision improvements that were made in the above
subdivision.
Enclosed for your files is a copy of the resolution accepting the street
improvements and the public storm, water, san'tary and electrical systems
installed within the subdivision. From the date of the resolution, the
City of Lodi will maintain the street and other public improv_ments
installed.
The enclosed letter has been sent to your bank so the Instrument of Credit
covering faithful performance can be exonerated. The Instrument of Credit
covering labor and materials must remain in effect until July 2, 1991, in
conformance with the Subdivision Map Act if no claims have been filed.

The City Council of the City of Lodi, at its meeting on April 3, 1991,
accepted the offsite improvements in the above subdivision. A copy of
the Resolution is enclosed for your files.
This letter is your authorization to exonerate the Instrument of Credit
covering faithful performance. The Instrument of Credit covering labor
and materials must remain in effect until July 2, 1991, in conformance
with the Subdivision Map Act. You will receive no further correspondence
regarding the release of the Instrument of Credit for labor and materials
unless a claim is filed.
