HomeMy WebLinkAboutAgenda Report - April 17, 1991 (56)CITY OF LODI COUNCIL COMMUNICpTiON AGENDA TITLE: Lower Sacramento Road, Avenue (Sargent Road) Appropriate Action MEETING DATE: April 17, 1991 PREPARED BY: Public Works Director Woodbridge Irrigation District Canal to Lodi Parking of Vehicles for Sale, Discussion and RECOMMENDED ACTION: That the City Council discuss the parking of vehicles for sale on the west side of Lower Sacramento Road between the Woodbridge Irrigation District (WID) canal and Lodi Avenue (Sargent Road), and take the appropriate action. BACKGROUND INFORMATION: At the request of the City Council, the Public Works Department has prepared the following information regarding vehicles for sale parked on the west side of Lower Sacramento Road between the WID canal and Lodi Avenue. This area is shown on Exhibit A. In the past, the City adopted an ordinance that regulated the display of vehicles for sale on all public streets; however, this ordinance was found to be unconstitutional and was therefore rescinded. Another less restrictive ordinance (Lodi Municipal Code Section 10.44.040) was then adopted which prohibited parking vehicles for sale within 200 feet of any signalized or four-way stop intersection (Exhibit B). Staff continued to receive complaints regarding vehicles for sale along Lower Sacramento Road, especially at Park nest Drive. To resolve this problem, "No Parking" zones were established on both sides of Lower Sacramento Road from Lodi Avenue to Turner Road at all of the probable problem locations. These "No Parking" zones corrected the problem north of Lodi Avenue but may have displaced the vehicles for sale to south of Lodi Avenue in front of Raley's Supermarket. Available accident records from 1987 to the present indicate that one of seven accidents occurring at this location was the type that could have been related to parked vehicles, although no mention of this was made in the accident report. This 1994 accident involved a driver exitina Raley's parking lot that was struck by a southbound vehicle. Traffic volume counts performed on Lower Sacramento Road south of Lodi Avenue in 1988 are approximately 11,400 vehicles per day. The posted speed on Lower Sacramento Ruad is 45 miles per hour. Traffic control at the intersection of Lower Sacramento Road at Lodi Avenue is currently provided by a four-way stop. However, a traffic signal at this intersection is under construction. In addition to vehicles for sale, trucks use the area, often for many days. Complaints include pollution and noise from idling trucks. If parking is restricted at this location, past experience indicates that these vehicles will most likely move across the street or to another location. If Council allows these vehicles to remain at this location, they may wish to direct staff to install 200 -foot "No Parking" zones on Lower Sacramento Road adjacent to the intersection as provided for per the Lodi Municipal Code. A. It is unlawful to park upon any public street, right-of-way or public prop- erty any vehicle. vessel or trailer display- ing a sign advertising such vehicle, vessel or trailer for sate which exceeds one square foot in size, or displaying more than one such sign, or to attach to or otherwise affix to such vehicle, vessel or trailer any other sign, banner, pennant, balloon or other device, intended to call attention to the fact that such vehicle, vessel or trailer is offered for sale. B. It is unlawful for any person or firm to have parked contemporaneously on the public streets or rights-of-way any- where within the city, three or more vehi- cles, vessels or trailers displaying a sign or signs indicating or advertising such vehi- cle, vessel or trailer for sale, irrespective of the proximity of such vehicles, vessels or trailers. C. Notwithstanding subsection A of this section, it is unlawful to park upon any public street, right-of-way or public place within two hundred feet of any sig- nalized intersection or four-way stop sign, any vehicle, vessel or trailer display- ing a sign advertising such vehicle, vessel or trailer for sale, irrespective of the size or number of such signs. The city council finds and declares that vehicles, vessels or trailers parked within two hundred feet of a signalized intcrsecton or four-way Exhibit B stop sign, and displaying such signs, con- stitute a traffic hazard by distracting the attention of passing motorists and pedes- trians away from other traffic moving through and about such intersections. For purposes of this section, "signalized intersection" means any intersection controlled by a traffic signal. D. It is unlawful for any person or firm, upon property belonging to another,. to park or display within thirty feet of the adjacent public street or right- of-wav as measured from the rear edge of the curb, gutter or sidewalk, or from the edge of the pavement if no curb, gutter or sidewalk exists, any vehicle, vessel or trailer displaying a sign or signs advertis- ing it for sale, without first obtaining the express consent of the owner or person having control ofsuch property. This sec- tion shall not apply to any private prop- erty appropriately zoned and licensed for the sale, repair, or storage of such vehi- cles, vessels or trailers. E. It is unlawful upon any public street, right-of-way or public property to park any vehicle, vessel or. trailer for the purpose of painting, greasing, or repair- ing such vehicle, vessel or trailer except for emergency repairs. F It is unlawful to park any vehicle, vessel or trailer upon any public street or right-of-way for the purpose of washing or polishing such vehicle, vessel or trailer or any part there0f when a charge is made for such service. These cars are there for the sole purpose of being sold. Not only is it an eyesore for the area but also a traffic hazard due the all the people double parking to look over the cars. This is a busy area anyway with the shopping center entrance - and the amount of cars especially on the weekends - are creating a problem. nn �^u, l� 0- .
