HomeMy WebLinkAboutAgenda Report - December 18, 2002 I-07OF �CITY OF LODI COUNCIL COMMUNICATION P �F' 4<I'ROR�IL AGENDA TITLE: Adopt Resolution Acknowledging Limited Commercial Vehicle Parking Within the City will Continue to be Permitted MEETING DATE: December 18, 2002 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council adopt a resolution acknowledging a private truck parking lot has not been developed in or near the City of Lodi and limited commercial vehicle parking will continue to remain in effect until such parking lot is developed. BACKGROUND INFORMATION: Commercial vehicle parking in the City of Lodi is governed by Lodi Municipal Code Section 10.52.050 (Exhibit A). In 1993, the City of Lodi began restricting truck parking on public streets. The most recent revision to the truck parking ordinance (Ord. 1697) was adopted in November 2000 and states that truck parking will be permitted in designated areas "until January 1, 2003, or until a private parking lot is developed or located in or near the city limits, at which time subsection C of this section shall become effective." The activation of subsection C would result in the prohibition of parking commercial vehicles on any public street unless the vehicle is in the process of being loaded or unloaded. Currently, truck parking is permitted in posted locations shown on Exhibit B. The January 1, 2003, deadline was included in Ordinance 1697 to encourage the development of a private lot. However, to prevent having to continually extend this date until a lot is developed, the ordinance also contained an "or" clause permitting truck parking until a private truck parking lot is developed. Although the Flying J Truck Stop on Interstate 5 and the Jahant Food & Fuel Stop on Highway 99 exist in the vicinity, they only offer truckers short-term parking and are not "parking lots." Although the passing of the January 2003 date has no effect on the ability to park trucks within the City, staff recommends that a resolution be adopted acknowledging no adequate private truck parking lot has been developed at the present time and that truck parking will be permitted per LMC 10.52.050 until such lot is developed and acknowledged by the City Council by a future resolution. A. It is unlawful to park a commercial vehicle exceeding a maximum gross vehicle weight rating (GVWR) of ten thousand pounds on any street in a residential district. For the purposes of this section, "residential district" means residentially zoned areas designated by the city zoning code (any "R" district) and includes schools, parks, playgrounds, community centers, churches, museums, golf courses (excluding miniature golf courses) and similar recreational uses of a noncommercial nature, and public utility service buildings where they are located in a residential district. B. It is unlawful to park a commercial vehicle exceeding a maximum gross vehicle weight rating (GVWR) of ten thousand pounds on any street in a commercial or industrial zone except where specifically signed to allow commercial vehicle parking between the hours of seven p.m. and seven a.m. unless otherwise indicated. This subsection B shall remain in effect until January 1, 2003, or until a private parking lot is developed or located in or near the city limits, at which time subsection C of this section shall become effective. C. It is unlawful to park a commercial vehicle exceeding a maximum gross vehicle weight rating (GWR) of ten thousand pounds on any street in a commercial or industrial zone. D. This section shall not prohibit parking of commercial vehicles in the process of being loaded or unloaded. (Ord. 1697 § 1, 2000; Ord 1680 § 3, 1999) EXHIBIT B CITY OF LO D I Truck Parking PUBLIC WORKS DEPARTMENT Allowable Parking Locations PUBLIC PROPERTY The City of Lodi regulates truck parking on public streets under Lodi Municipal Code Section 10.52.050. Per this section, trucks exceeding a maximum gross vehicle weight rating of 10,000 pounds can park only along signed portions of the streets shown on this map. Parking in some areas is allowed only between the hours of 7 p.m. and 7 a.m., with all day parking allowed in other areas. Truck parking on all other streets is prohibited unless the vehicle is in the process of being loaded or unloaded. If a private parking lot is not developed or located by January 1, 2003, truck parking on public streets will not be permitted within the city limits of Lodi except while the vehicle is in the process of being loaded or unloaded. PRIVATE PROPERTY The City of Lodi also regulates truck parking on private property in residential zones under Lodi Municipal Code Section 17.57.190. This section prohibits the parking of vehicles which are strictly commercial in nature and have a gross load capacity of one and one-half tons. The types of vehicles include but are not limited to tow trucks, ambulances, mini -buses, large delivery and/or service trucks. Vehicles placed out of public view and located behind the designated front setback line or in the process of loading or unloading goods or people are exempt from this restriction. NOW, THEREFORE, BE IT RESOLVED, that the Lodi City Council does hereby acknowledge that no adequate truck parking lot has been developed and that truck parking should be permitted to continue per Lodi Municipal Code §10.52.050 until such time as a lot is developed.
