AGENDA TITLE: Adoption of Ordinance No. 1581 entitled, "An Ordinance of the
City Council of Lodi amending Chapter 10.52 of the Lodi
Municipal Code by Adding a New Section Thereto Relating 3
Commercial Vehicle Parking Noise Restrictions"

RECOMMENDED ACTION: Following reading by title, it would be appropriate for
the City Council to adopt Ordinance No. 1581.
BACKGROUND INFORMATION: Ordinance No. 1581 entitled, "An Ordinance of'the
City Council of Lodi amending Chapter 10.52 of the
Lodi Municipal Code by Adding a New Section Thereto
Relating to Commercial vehicle Parking Noise
Restrictions".
Pursuant to State statute, ordinances may be adopted five days after their
introduction following reading by title.
This Ordinance has been approved as to form by the City Attorney.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LODI
AMENDING CHAPTER 10.52 OF THE LODI MUNICIPAL CODE
BY ADDING A NEW SECTION THERETO RELATING TO
COMMERCIAL VEHICLA PARKING NOISE RESTRICTIONS

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LODI AS FOLLOWS:
SECTION I., Chapter 10.52 - Regulation of Commercial Vehicle Travel and 4
Parking - is hereby amended by adding thereto a new Section 10.52.080
relating to Parking Noise Restrictions, to read as follows:
10.52.090 Parking Noise Restrictions,
A. It is unlawful on any public right of
way to stop, park or leave standing for more
than five consecutive minutes, a c -n ercial
vehicle exceeding a maximum gross vehicle
weight rating of 10,000 pounds within 250 feet
of a "residential district" while operating
diesel and/or auxiliary engines between the
hours of 10:00 p.m. and 7:00 a.m. Auxiliary
engines include but are not limited to
refrigerator units. This distance shall be
measured in a straight line within the public
right-of-way from the engine to the nearest
point on the district boundary (i.e., not
around corners or through private property).
The term "residential district" is as defined
in L.M.C. Section 10.52.050(a). (Vehicle Code
22507)
B. This section shall not prohibit parking
of commercial vehicles in the process of being
loaded or unloaded.
C. This section shall not apply to parking
on state highways.
SECTION 2. All ordinances and parts of ordinances in conflict herewith
are repealed insofar as such conflict may exist.

SECTION 3. .Alis ordinance shall be publish-.. one time in the "Lodi
News Sentinel", a daily newspaper of general circulation printed and
published in the City of Lodi and shall be in force and take effect
thirty days from and after its passage and approval.
