AGENDA TITLE: Public Hearing to Consider Resolution/Order to Vacate the Alley West of
Washington Street, from East Vine Street to 150.3 Feet North of East Vine Streit
MEETING DATE: October 6, 1993

RECOMMENDED ACTION: That the City Council, after reviewing the finding by the Planning
Commission and the public comments from the subject public hearing,
take the appropriate action on this proposed abandonment.
BACKGROUND INFORMATION: At its regular meeting of September 1, 1993, the City Council adopted
a resolution of intention to vacate an alley west of Washington Street,
from East Vine Street to 150.3 feet north of East Vine Street,
reserving, however, and excepting from the vacation, a permanent
easement and right the, ain to construct, maintain, repair and operate lines for public utilities, both
publicly and privately owned, in, over, and across said alley; and referred the matter to the Planning
Commission.
At the request of the Providence Reformed Church at 245 East Vine Street, this alley abandonment
was initiated by City staff. The subject alley right of way between Vine Street and Chert' Street has
never been maintained by the City of Lodi. The portion proposed to be vacated was paved by the
Providence Reformed Church and has been striped and made part of their overall parking lot. It is
possible to travel from Cherry Street to Vine Street; however, the northerly portion of the alley,right of
way is unimproved (dirt) and the sou;hedy portion, paved by the Church, has no standard alley -
approach access to Vine Street. Presently, in order to use the dedicated alleyway, it is necessary to
traverse the remainder of the 3hurch's parking lot and use their driveway onto Vine Street. Since there
were no existing structures on the adjacent property at 235 East Vine Street which took access off the
alley, it was our feeling that there was no public need.
The Planning Commission, at its meeting of September 27, 1993, held a hearing to determine public
need, present or future, for this alley. The owner of 235 East Vine Street, who purchased the property
within the last year, indicated to the Planning Commission that he bought the property after confirming
that it had alley access. It was his intention to upgrade this rental property, providing an off-street
garage with z:cess off of the alleyway and also providing for possible RV parking. The Planning
Commission, atter hearing the concerns of the adjacent property owner, determined that there was
public need and they are providing that finding to the City Council for its public hearing on this matter to
be held October 6, 1993.

Pacific Bell, King Videocable. PG&E, and City of Lodi utilities have all indicated the proposed
abandonment is acceptable if it is approved on the condition that a permanent easement be reserved
as indicated above.

%HEREAS, this City Council acting in accordance with provisions
of Part III of Division 9 of the Streets and Highways Code of this
State, did on the 1st day of September, 1993 pass and adopt a
Resolution of Intention No. 93-108 therein declaring the intention of
said City Council to vacate that portion of the alley west of
Washington Street, from East Vine Street to 150.3 feet north of East
Vine Street, Lodi, California, County of San Joaquin, State of
California, reserving, however, and excepting from the vacation, a
permanent easement and right therein to construct, scaintain, repair and
operate lines for public utilities, both publicly and privately owned,
in over, and across said alley, and more particularly described as
follows, to wit:
The alley located west of 245 East Vine Street, as shown on
Exhibit A attached hereto;
WHEREAS, said notice of said intended vacation was regularly
given by publication and by posting, both in time, form and manner as
required by law as is evidenced by affidavits on file and on record in
the office of the City Clerk of the City of Lodi; and
WHEREAS, in accordance with the provisions stated in Resolution
No. 93-108 and also contained in the posted notices of the adoption of
said resolution, notice was given that a public hearing would be held
before the City Council in the City Council Chambers, Carnegie Forum,
305 West Pine Street, Lodi, California, beginning at 7:00 p.m. on
Wednesday, October 6, 1993, where and when any person interested in or
objecting to said vacation cou12 appear and be heard in relation
thereto; and
WHEREAS, at that time and place, a public hearing was held and
conducted and testimony received for and against the vacation
contemplated, and from the evidence submitted, the City Council of the
City of Lodi did determine that said portion of said alley is
unnecessary for present or future public use and did so find and
declare; and
WHEREAS, the Planning Commission did find that the subject
vacation was consistent with the General Plan of the City of Lodi;
NOW, THEREFORE, BE IT RESOLVED, that pursuant to the findings and
under the authority of Section 8323 of the Streets and :iighways Code of
the State of California, that there is hereby abandoned that portion of
the alley west of Washington Street, from East Vire Street to 150.3
feet north of East Vine Street, Lodi, California, and more particularly
described as follows:

NOTICE IS HEREBY GIVEN that on Wednesday, at the hour of 7:00p,m., or as
soon thereafter as the matter may be heard, the City Council will conduct a
public hearing to consider the following matter:
a) Intention to Vacate the Alley West of Washington Street, from
East Vine Street to 150.3 Feet North of East Vine Street
All interested persons are invited to present their views and comments on this
matter. Written statements may be filed with the City Clerk at any time prior
to the hearing scheduled herein, and oral statements may be made at said
hearing.

BE IT RESOLVED by the Lodi City Council as follows:
Section 1. It is the intention of the Lodi City Council, acting
in accordance with the provisions of Part 3 of Division 9 of the
Streets and Highways Code of the State of California, to vacate, close.
and abandon as a public alley the following alley situated in the City
of Lodi, County of San Joaquin, State of California, more particularly
described as follows:
The alley located WEST OF 245 East Vine Street, as shown on
Exhibit A attached hereto.
Reserving, however, and excepting from the vacation of said
alley, the permanent easement and the right therein to construct,
maintain, repair and operate lines for public utilities, both
publizly and privately owned, in, over, and across said alley.
Section 2. This matter is hereby referred to the Lodi Planning
Commission.
Section 3. NOTICE IS HEREBY GIVEN that this City Council does
hereby fix WEDNESDAY, OCTOBER 6, 1993 at the hour of 7:00 p.m, in the
City Council Chambers, Carnegie Forum, Carnegie Forum, 305 West Pine
Street, Lodi, California as the time and place when and where all
persons interested in or objecting to the vacation herein proposed may
appear before this City Council and be heard.
Section 4. Upon adoption of this resolution, the Superintendent
of Streets shall post„ or cause to be posted, notice of such passage
and of the time and place set forth herein for public hearing, in
accordance with and in the time, form and manner as prescribed by law
for the vacation of streets.
Section S. This resolution shall be published one time in the
"Lodi News Sentinel", a newspaper of general circulation printed and
published in the City of Lodi, said publication to be completed at
least fifteen days prior to said hearing.

approach accesr. to Vino Street Presently, in order to use the dedicated alleyway, it is necessary to
traverse the remainder of the Church's parking lot and use their driveway onto Vine Street Since there
were no existing structures on the adjacent property at 235 East Vine Street which took access off the
alley, it was our feeling that there was no public need.
The Planning Commission, at its meeting of September 27, 1993, held a hearing to determine public
need, present or future, for this alley. The owner of 235 East Vine Street, who purchased the property
within the last year, indicated to the Planning Commission that he bought the property after confirming
that it had al.ey access. It was his intention to upgrade this rental property, providing 2n off-street
garage with access off of the alleyway and also providing for possible RV parking. The Planning
Commission, after hearing the concerns of the adjacent property owner, determined that there was
public need and they are providing that finding to the City Council for its public hearing on this natter to
be held October 6, 1993.

BE IT RESOLVED by the Lodi City Council as follows:
Section 1. It is the intention of the Lodi City Council, acting
in accordance with the provisions of Part 3 of Division 9 of the
Streets and Highways Code of the State of California, to vacate, close.
and abandon as a public alley the following alley situated in the City
of Lodi, County of San Joaquin, State of California, more particularly
described as follows:
The alley located WEST OF 245 East Vine Street, as shown on
Exhibit A attached hereto.
Reserving, however, and excepting from the vacation of said
alley, the permanent easement and the right therein 1-o construct,
maintain, repair and operato lines for public utilities, both
publicly and privately owned, in, over, and across said alley.
SSpction This matter is hereby referred to the Lodi Planning
Commission.
Section 3. NOTICE IS HEREBY GIVEN that this city Council does
hereby fix WEDNESDAY. OCTOBER 6, 1993 at the hour of 7:00 p.m. in the
City Council Chambers, Carnegie Forum, Carnegie Forum, 305 West Fine
Street, Lodi, California as the time and place when and where all
persons interested in or objecting to the vacation herein proposed may
appear before this City Council and be heard.
Section 4._ Upon adoption of this resolution, the Superintendent
of Streets shall post, or cause to be posted, notice of such passage
and of the time and place net forth herein for public hearing, in
accordance with and in the time, form and manner as prescribed by law
for the vacation of streets.
Section 5.. This resolution shall be published one time in the
"Lodi News Sentinel'. a newspaper of general circulation printed and
published in the City of Lodi, said publication to be completed at
least fifteen days prior to said hearing.

VACATING THE ALLEY WEST OF WASHINGTON STREET,
FROM EAST VINE STREET TO 150.3 FEET NORTH OF EAST VINE STREET

WHEREAS, this City Council acting in accordance with provisions
of Part III of Division 9 of the Streets and Highways Code of this
State, did on the 1st day of September, 1993 pass and adopt a
Resolution of Intention No. 93-108 therein declaring the intention of
said City Council to vacate that portion of the alley west of
Washington Street, from East Vine Street to 150.3 feet north of East
Vine Street, Lodi, California; County of San Joaquin, State of
California, reserving, however, and excepting from the vacation, a
permanent easement and right therein to construct, maintain, repair and
operate lines for public utilities, both publicly and privately owned,
in over, and across said alley, and more particularly described as
follows, to wit:
The alley located west of 245 East Vine Street, as shown on
Exhibit A attached hereto;
WHEREAS, said notice of said intended vacation was regularly
given by publication and by posting, both in time, form and manner as
required by law as is evidenced by affidavits on file and on record in
the office of the City Clerk of the City of Lodi; and
WHEREAS, in accordance with the provisions stated in Resolution
No. 93-108 and also contained in the posted notices of the adoption of
said resolution, notice was given that a public hearing would be held
before the City Council in the City Council Chambers, Carnegie Forum,
305 West Pine Street. Lodi, California, beginning at 7:00 p.m. on
Wednesday, October 6, 1993, where and when any person interested in or
objecting to said vacation could appear and be heard in relation
thereto; and
WHER AS, at that time and place, a public hearing was held and
conducted and testimony received for and against the vacation
contemplated, and from the evidence submitted, the City Council of the
City of Lodi did determine that said portion of said alley is
unnecessary for present or future public use and did so find and
declare; and
WHEREAS, the Planning Commission did find that the subject
vacation was consistent with the General Plan of the City of Lodi;
NOW, THEREFORE, BE IT RESOLVED, that pursuant to the findings and
under the authority of Section 8323 of the Streets and Highways Code of
the State of California, that there is hereby abandoned that portion of
the alley west of Washington Street, from East Viae Street to 150.3
feet north of East Vine Street, Lodi, California, and more particularly
described as follows:
