AGENDA TITLE: Cancellation of Concession contract and proposed new
usage for Lodi Lake Concession Building
MEETING DATE: February 6, 1991
PREPARED BY: City Manager
RECOMMENDED ACTION: That the City Council receive the staff report
and take action as deemed appropriate.
BACKGROUND INFORMATION: The attached memo (Exhibit A), prepared by the
Parks and Recreation Director, discusses the
present status of the Lodi Lake Park concession
stand operation and the agreement that pertains
thereto. Council approval is requested prior to moving forward with the
implementation of the staff recommendation that the concession stand be
closed and the building converted for use as an information/interpretive
center.

SUBJECT: CANCELLATION OF CONCESSION CONTRACT/NEW USE FOR LODI LAKE
CONCESSION BUILDING
Carry Jacobs, our contract concessionaire, has asked to be released
from his contract with the City of Lodi. According to our agreement
either party can rec-,aest termination of the contract by giving sixty
days notice; Mr. Jacobs is hereby giving us his notice.
Marilyn Field, our Recreation Superintendent who handles our working
relations with the concessionaire, tells me this is no great loss.
Marilyn indicated that she considered cancelling this agreement
earlier due to less than satisfactory operation of the concession
stands at the Softball Complex, Armory Park, and Lodi Lake.
There is a year remaining on the current contract. Marilyn has
contacted the San Joaquin County Health Department to have the stands
at the Complex and Armory reviewed for compliance with current food
standards. She then plans to contact the BOBS organization to see if
they would be interested in operating these two stands for the coming
year to assist with their fundraising efforts to support youth
sports. If they choose not to operate the stands, a decision must be
made of whether to look for a new concessionaire or consider having
the Parks and Recreation Department operate the concession stand.
The Health Department has again reviewed the Lodi Lake stand and
given us a lengthy list of corrections required prior to reopening
this summer. Records show the low volume of use of the concession
stand by people using the Lake. It is staff's recommendation not to
reopen the concession stand at Lodi Lake. Staff, including the Park
Rangers and nature people, request we use the concession building as
an information/interpretive center and small meeting place for local
groups. Funding for the building conversion would in part come from
the Lake budget, docent fundraising, and possibly service club
funding.

Attached is a list of possible uses for the facility. We will do our
best to try and make any improvements internally and create volunteer
enthusiasm to assist with labor and operations. We have assigned
part-time Park Ranger Barbara Brown, currently serving as our
interpretive ranger, to develop various programs/volunteers which
will center and work out of this building; i.e., junior ranger
program, docent walk volunteers, nature tours, summer nature forum,
small nature exhibits, etc. Barbara is a very enthusiastic and
energetic person --seeing a need and doing something about it. She's
the right person at the right time for this newfound interest in our
Lake park and the nature and environmental concerns of our citizens.
This should address our most current happenings concerning concession
operations and the Lake park building use. The Parks and Recreation
Commission is in full support of this request.

I received a copy of the letter that Barry Jacobs, aka E.R.
Fairgrounds Inc. sent to you requesting that his contract with the
City of Lodi be. terminated as per the terms listed in his contract
with us.
Marilyn Field indicated to me that this should be no great loss to
the City as her recommendation to me was to call Jacobs in and
discuss our concerns regarding his operation at Lodi Lake and the
Softball Complex this past season and to stipulate to Jacobs that
unless our concerns were answered our position would be to
recommend to you and the Council that his contract be terminated.
The County Health Department gave us a lengthy and costly list of
items to be addressed prior to opening the concession stand at Lodi
Lake this summer, that staff and the Parks and Recreation
Commission felt the stand should not be used for food sales.
There i- a year remaining on the current contract. Marilyn has
contacted the San Joaquin County Health District to have the stands
at the Complex and Armory reviewed for compliance with current food
service standards. She then plans on contacting the Boosters of
Boys and Girls Sports to determine if their organization would be
interested in operating these two stands for the coming year.
Should the B.O.B.S. choose not to operate the stands I would then
come to you with Staff and Commission recommendations as to what
might be done.
