RECOMMENDED ACTION: That the City Council conduct a public hearing to
consider Planning Commission's recommendation to approve
the following requests of David C. Sproul:
1. to prezone the parcels at 5909 and 6161 East State Route 12 (APN's 049-040-07
and 049-130-22) M-1, Light Industrial; and
2. to certify the filing of a Negative Declaration by the Community Development
Director as adequate environmental documentation on the above project.
BACKGROUND INFORMATION: Mr. Sproul's family owns the property at 6161 East State
Route 12 (Victor Road) and is desirous of annexing it to
the City. In order to accomplish the Sprouls' request the property to its west
(5909 East State Route 12) which belongs to the John Taylor Fertilizer Company must
also be annexed.
The Planning Commission has recommended that both parcels be prezoned M-1, Light
Industrial, which is consistent w°th the General Plan. The San Joaquin Local Agency
Formation Commission requires cities to prezone properties before the annexation
process can begin.

JUNE 14, 1993
The next item for review was the request of David C. Sproul to prezone
the parcel at 6161 East Hwy 12 to M-1, Light Industrial and to certify
the filing of a negative declaration by the Community Development
Director as adequate environmental documentation on the project. The
matter was introduced to the Commission by Community Development
Director Schroeder. Mr. Schroeder explained that the prezoning was the
first step in the annexation procedure to bring this property into the
City. In addition to the Sproul property, the City has added an
additional property to the west across the Central California Traction
Line to make the annexation more contiguous to the City. He noted that
the Sproul property contains the old Roma Winery builaing which has
been divided up and is occupied by a number of different businesses.
The applicant has no immediate plans to do any further development on
the site.
Chairman Mindt asked if anyone in the audience wished to speak on this
matter. Coming forward to speak was David Sproul, 6161 East Hwy 12.
Mr. Sproul requested the Planning Commission's consideration for the
prezoning request. Following a brief discussion the Planning
Commission, on a motion by Commissioner Griffith and a second by
Commissioner Stafford, unanimously approved the request to prezone the
parcel at 6161 East Hwy 12 to M-1, Light Industrial, and to certify the
filing of a negative declaration.

AMENDING THE OFFICIAL DISTRICT MAP OF THE CITY OF LODI AND THEREBY
PREZONING THE PARCELS LOCATED AT 5909 AND 6161 EAST STATE ROUTE
12 (APN'S 049-040-07 AND 049-130-22) M-1, LIGHT INDUSTRIAL.

BE IT ORDAINED BY THE LODI CITY COUNCIL AS FOLLOWS:
SECTION 1. The Official District Map of the City of Lodi adopted by
Title 17 of the Lodi Municipal Code is hereby amended as follows:
The parcels located at 5909 and 6161 East State Route 12 (APN's
049-040-07 and 049-130-22) are hereby prezoned M-1, Light Industrial,
as shown on vicinity map on file in the office of the City Clerk.
SECTION 2. The alterations, changes, and amendments of said Official i
District Map of the City of Lodi herein set forth have been approved by
the City Planning Commission and by the City Council of this City after F
public hearings held in conformance with provisions of Title 17 of the
Lodi Municipal Code and the laws of the State of California applicable
thereto.
SECTION 3. All ordinances and parts of ordinances in conflict
hRrewith are rooealed insofar as such conflict may exist.
SECTION 4. This ordinance shall be published one time in the "Lodi
News Sentinel", a daily newspaper of general circulation printed and
published in the City of Lodi and shall be in force and take effect
thirty days from and after its passage and approval.

NOTICE IS HEREBY GIVEN that on Wednesday, at the hour of 7:00 p.m., or as
soon thereafter as the matter may be heard, the City Council will conduct a
public hearing to consider the following matter:
a) Planning Connission's recommendation to approve the following
requests of David C. Sproul:
1. to prezone the parcels at 5909 and 6161 Bast State Route 12
(APN's 049-040-07 and 049-130-22) M-1, Light Industrial; and
2. to certify the filing of a Negative Declaration by the
Community Development Director as adequate environmental
documentation on the above project.
Information regarding this item may be obtained in the office of the
Community Development Director at 221 West Pine Street, Lodi, California.
All interested persons are invited to present their views and comments on this
matter. Written statements may be filed with the City Clerk at any time prior
to the hearing scheduled herein, and oral statements may be made at said
hearing.
If you challenge the subject matter in court, you may be limited to raising only
those issues you or someone else raised at the Public Hearing described in
