AGENDA TITLE: Adopt resolution awarding the contract for Henning Substation Block Wall and Gate project
($69,600.00) and appropriate funds (EUD)

RECOMMENDED ACTION: That the City Council award the contract for Henning Substation Block Wall
and Gate project to the low bidder System 3, Inc. Carmichael, CA, in the
amount of $69,600.00 and appropriate funds for the project.
BACKGROUND INFORMATION: On August 28, 2002, four bids were received and opened. The bid results
are tabulated below:

This project will install a 12.5± ft. tall concrete masonry unit (CMU) block wall along the west property line of the
substation, replacing an existing chain link fence, as well as a 16 ft. wide gate in the south east corner of the existing
CMU wall.
Plans and Specifications were approved by the City Council at the meeting of August 7, 2002.
During the bidding process, one addendum was issued. This addendum modified the licensing requirement of the
contractor from a Class B to "Bids must be from appropriately State of California licensed contractors". This change
clarified who could actually bid the project. The addendum did not change the design or specifications nor did it have
any cost impact.
The low bidder did not acknowledge receipt of the addendum with the bid proposal. The second low bidder did file a
complaint regarding this matter. The City Council did act on this complaint at the meeting of November 20, 2002. It
should be noted that all the bidders have the Class B license and that the subcontractors listed with both the low and
second low bidders have the appropriate licenses for the type of work they will be performing per the bid proposal.
It is further recommended that the City Council appropriate $80,660 for this project. This appropriation will fund the
construction contract ($69,600), contingencies (10%) and the construction management ($4,100) by the architectural
firm utilized for the design of the project.

A RESOLUTION OF THE LODI CITY COUNCIL AWARDING
THE BID FOR HENNING SUBSTATION BLOCK WALL AND
GATE PROJECT, AND FURTHER APPROPRIATING
FUNDS FOR THIS PROJECT
WHEREAS, in answer to notice duly published in accordance with law and the order of
this City Council, sealed bids were received and publicly opened on August 28, 2002 at 11:00
a.m. for Henning Substation Block Wall and Gate Project, described in the specifications
therefore approved by the City Council on August 7, 2002; and
WHEREAS, said bids have been compared, checked, and tabulated and a report
thereof filed with the City Manager as follows:

NOW, THEREFORE, BE IT RESOLVED by the Lodi City Council that the award of the
bid for Henning Substation Block Wall and Gate Project, be and the same is hereby awarded to
the low bidder, System 3, Inc., of Carmichael, CA, in the amount of $69,600.00; and
BE IT FURTHER RESOLVED, that funds in the amount of $80,660.00 be appropriated
for this project.

At the City Council meeting of December 4, 2002, your firm was awarded the contract for
Henning Substation, Block Wall and Gate in the amount of $69.600.00. This award was based
on your bid being the lowest responsible bid coupled with your letter agreement dated October
15, 2002, to extend the bid by 60 days in order for the formal bid protest to be carried out. As
you know a bid protest was filed by a bidder. The bids received for the project are tabulated

At this time various documents need to be completed and/or provided by you in order to finalize
the Contract for this project. Therefore, enclosed with this letter you will find:
Contract, 3 copies.
Please execute each copy on page 4.3 under CONTRACTOR and return the three
copies to the City for execution. The effective date of this contract will be the date the
City executes the Contract.
Contract Surety Bonds (Labor and Materials, Faithful Performance).
One (1) copy of each. Please have these bonds completed and submitted with the
Contract. See section 2.900 of "Information to Bidders". The bonds must be executed
on the forms enclosed with this letter in addition to any other documents your Surety
Company may wish to supply. The "California All -Purpose Acknowledgment" must also
be completed for each bond. Note, the bonds shall be executed by an admitted surety
insurer.

Insurance Certificates (to be provided by your insurance carrier).
Please provide and include the insurance certificates with the Contract, as required per
section 2.1100 and 2.1200 of "Information to Bidders". The "Certificate Holder's"
address should be City of Lodi, 221 West Pine Street, Lodi, California, 95240.
Note under section 5-413, the "Additional Named Insured Endorsement" shall include
both the City of Lodi and the Woodbridge Irrigation District.
Subcontractor List/Building Permit. Please complete this form and return one copy
with the contract documents to the undersigned. Retain a copy of the completed form
for use by you to obtain the Building Permit. A City of Lodi Building Permit is required
for this project. The permit has been processed by the Electric Utility Department and is
ready for pick-up, by you, at the Building Department at City Hall, 221 W. Pine Street.
The permit number is B 7018. However, in order for you to obtain the permit the
completed "Subcontractor List" must be submitted. Please note, the City requires that
all contractors (prime and sub(s)) have a current Business Tax Certificate issued by the
City of Lodi, Finance Department. Verification of such certificate for all contractors will
be done prior to you being issued the building permit. If you or any of your
subcontractors do not have a current City of Lodi, Business Tax Certificate, the
certificate can be obtained at the Finance Department, 212 W. Pine Street at a first time
cost of $50.00 each. The column identified as "City Business License No." on the
"Subcontractor List" is the column to use for the Business Tax Certificate identification
number.

Upon execution of the contract a pre -construction meeting will be scheduled at the Electric
Utility Service Center, 1331 S. Ham Lane, Lodi CA. Please indicate the name or names of the
individual(s) in your organization we should contact regarding the specific date and time of the
pre -construction meeting.
A copy of the "Plans and Specifications" for this project has been enclosed for your reference.
Upon execution of the contract by the City your Bid Bond will be returned.
