AGENDA TITLE: Acceptance of Improvements at Sunwest Plaza, 2330 West Kettleman Lane

RECOMMENDED ACTION: That the City Council adopt the attached resolution
accepting the development improvements for Sunwest Plaza,
2330 West Kettleman Lane.
BACKGROUND INFORMATION: Improvements at Sunwest Plaza, 2330 West Kettleman Lane,
have been completed in substantial conformance with the
requirements of the Improvement Agreement between the City
of Lodi and Wal-Mart Stores, Inc., as shown on Drawings
No. 90D070 through 90D076, 90D078 through 90D080 and 91DO46 through 91D052, and as
specifically set forth in the plans and specifications approved by the City Council
on February 5, 1992.
The streets to be accepted are as follows:

TOTAL NEW MILES OF CITY STREETS 0.0
FUNDING: Not applicable.

A RESOLUTION OF THE LODI CITY COUNCIL
ACCEPTING THE DEVELOPMENT IMPROVEMENTS INCLUDED IN THE IMPROVEMENT
AGREEMENT FOR SUNWEST PLAZA, 2330 WEST KETTLEMAN LANE

The City Council of the City of Lodi finds:
1. That all requirements of the Improvement Agreement between the
City of Lodi and Wal-Mart Stores, Inc., for the improvements for
Sunwest Plaza, 2330 West Rettleman Lane have been substantially
complied with. The improvements are shown on Drawings Nos.
90D070 through 90DO76, 90DO78 through 91D080, and 92DO46 through
91DO52 on file in the Public Works Department, and as
specifically sat forth in the plans and specifications approved
by the City Council on February 5, 1992.
2. The streets to be accepted are as follows:

I hereby certify that Resolution No. 93-44 was passed and adopted
by the City Council of the City of Lodi in a regular meeting held April

SUBJECT: Sunwest Plaza, 2330 West Kettleman Lane
(Wal-Mart Store 11789)
The City Council of the City of Lodi, at its meeting on April 7, 1993,
accepted the public improvements that were made in the subject project.
Enclosed for your files is a copy of the resolution accepting the public
improvements. From the date of the resolution, the City of Lodi will
maintain the street and other public improvements installed within
rights-of-way and public utility easements as shown on the approved plans.
The enclosed letter has been sent to your bank so the Instrument of Credit
covering faithful performance can be exonerated. The Instrument of Credit
covering labor and materials must remain in effect for a period of 90
days from the date of the resolution, in conformance with State law. On
July 6, 1993, we will notify your bank that this Instrument of Credit can
be released if no claims have been filed. You should be aware that we
have received an inquiry from H. L. Kennedy Associates stating that they
had not been paid and asking for information on the labor and materials
surety.
