RECOMMEMED ACTION: Following reading by title, it would be appropriate for the
City Council to adopt Ordinance No. 1569.
BACKGROUND INFORMATION: Ordinance No. 1569 entitled. -An Ordinance of the City
Council of the City of Lodi Amending Lodi Municipal Code
Chapter 15.44 - Off -Site Improvements and Dedications,
Section IS.44.040(A) - Exemption or Deferment- was
introduced at the regular meeting of the Lodi City
Council held March 17, 1993.
Pursuant to State statute. ordinances may be adopted five days after their
introduction following reading by title.
This Ordinance has been approved as to form by the City Attorney.
FUNDING: None required.

-R=10 L. Lodi amicipal Code Section 15.44.040 is hsreby amended to
read as follm s:
15-44-044 &MMU ion or deferml -
A. The requirements of Section 15.44.030 do not apply if the
cost of development within any twelve-month period is determined by the
public works director to be lass than twenty-five thousand dollars.
This amount will be adjusted by the public works director on July 1st
of each year, beginning on July 1, 1994, based upon the change of the
U.S. Average Rngineering hews -Record Building Cost Index, using the
following formula:
EM Index for June
Amount a $25,000 X --------------------------------------
2838 (ENR Index for June 1992
and that the amount shall be rounded to the nearest one hundred dollars.
B. (Section B remains unchanged.)
SRCTION 2. All ordinances and parts of ordinances in conflict herewith
are repealed insofar as such conflict may exist.

published in the City of Lodz and shall be in force and take effect

that Ordinance No. 1569 was introduced at a regular meeting of the City
Council of the City of Lodi held March 17, 1993 and was thereafter
passed, adopted and ordered to print at a regular meeting of said
Council held April 7, 1993 by the following vote:
Ayes: Council Members - Davenport, Mann, Sieglock, Snider
and Pennino (Mayor)
Noes: Council Members - None
Absent: Council Members - None
Abstain: Council Members - None
I further certify that Ordinance No. 1569 was approved and signed by
the Mayor on the date of its passage and the sane has been published
pursuant to law.
