Bridgetowne, Unit No. 3, Tract No. 2864, Sewer Lateral Replacements

RECOMMENDED ACTION: That the City Council approve the plans and specifications for the above
project and authorize advertising for bids.
BACKGROUND INFORMATION: This project is to replace 15 defective sewer services in the
Bridgetowne, Unit No. 3, subdivision. The work consists of replacing
15 sewer laterals, and other incidental and related work as shown on
the plans and specifications for the above project.
In December 1999, the City received letters from several residents of the Bridgetowne, Unit No. 3,
subdivision regarding sewer problems at their homes. Further investigation and video inspection by the
City revealed that 15 sewer laterals were nonconforming to City standards. The defective sewer
services are the result of poor trench compaction by the developer's contractor and this has caused a
reverse slope condition within the sewer laterals.
Since the defective work was covered under the 12 -month warranty, staff requested the developer, on
numerous occasions, to repair the defective sewer laterals at the developer's expense (see attached
letter). The developer has been nonresponsive to the City's demands and has verbally conveyed that
the corrective work will not be done. As a result, staff recommends that the repairs be made without
further delay. The City will need to pursue legal action to recover all costs from the developer after
completion of the repairs.
The plans and specifications are on file in the Public Works Department.

SUBJECT: Bridgetowne Unit No. 3, Sewer Service Corrections

We have previously notified you of construction deficiencies at many locations within your
subdivision, and this notification was submitted during the 12 -month warranty period of the
Improvement Agreement on this project. Under the terms of that Agreement, you are required to
make repairs to the submitted deficiencies.
To date, you have directed your contractor to investigate the deficiencies, but we have not received a
proposal as to how or when you would make the necessary corrections. Again, we direct you to
make necessary repairs to the sewer service laterals at the locations listed on enclosed Exhibit A. All
repairs shall conform to City of Lodi Standard Plans and Construction Specifications. In cases where
the improvements affect existing driveways, replacement driveway materials shall match the existing,
and the limit of replacement is shown on the enclosed Exhibits B - E. The lateral trench work in the
street is not shown on Exhibit B. All trench cuts in the street shall conform to Standard Plan 506 with
a Type I patch. In addition, all cleanouts and water service boxes must be reset to the proper grade.
All repairs must be commenced within 60 days from receipt of this letter and then completed within
45 days. Failure to meet this deadline will require the City to perform the necessary repairs and to
pursue reimbursement as provided for by the terms of the Improvement Agreement.
Please provide the City with your schedule for performing this work within 14 days. Should you have
