Governments for Lodi Lake Bicycle Path Project (Phase II)

RECOMMENDED ACTION: Adopt a resolution authorizing the City Manager to sign assurances to
San Joaquin Council of Governments (COG) for the Lodi Lake Bicycle Path
Project (Phase II).
BACKGROUND INFORMATION: There are competitive and noncompetitive Measure K Bicycle Program funds
earmarked for the Lodi Lake bike path, and the City needs to assure COG of a
number of issues related to those funds (see attached guidelines). In addition,
staff is recommending that the City request COG transfer the Transportation
Enhancement Activities (TEA) grant funds to the Kettleman Lane Gap Closure Project (see separate staff report on that
item). As part of that request, the City needs to assure COG that by transferring the TEA money the City intends to
construct the Lodi Lake Bike Path Project (Phase 11).
The City is requesting $206,000.00 in competitive and noncompetitive Measure K Bicycle Program money. Included
in this figure is $11,485.24 of competitive bicycle money that was "saved" from the Kettleman Lane Bicycle Loop
Detector Project and $39,520.00 from the Century Boulevard Bike Path, which will not be delivered in the near
future. Also, $54,514.76 was "saved" from the Lodi Lake Bike Path Project (Phase 1). $100,480.00 is being
requested from existing and future noncompetitive bicycle allocation. An estimated balance of $65,000.00 will
remain through fiscal year 2010/11. Also, there will be at least two more competitive bicycle -funding cycles through
fiscal year 2010/11.
The Parks and Recreation Department has earmarked $60,000.00 of capital funds, and the Electric Utility Department
will contribute $30,000.00 for the lighting. The total funding currently available for the Phase II portion stands at
$296,000.00. The Parks and Recreation Department plans to go out to bid to get a firm price for the project and then
consider any shortfall with additional capital funds, probably Parks and Recreation Development Impact Fee funds or
Transportation Development Act (TDA) funds. The current construction estimate is $393,000.00.

NON-COMPETITIVE BICYCLE PROJECT GUIDELINES
ASSURANCES
I hereby certify, and am authorized to make, the following assurances on behalf of the agency claiming
Measure K Bicycle Program (PROGRAM) non-competitive funds.
This project lies entirely within San Joaquin County, and does not duplicate an existing bicycle facility and
that the projects is, or will be, contained in an adopted local or regional bicycle plan.
The claim for the project has been authorized by the governing board of my agency in a resolution or COG
cooperative agreement that includes all stipulated understandings and assurances as defined in this claim.
The project is not by nature a maintenance or rehabilitation project, and this agency certifies that it will bear
responsibility for the maintenance and operation of the facility presented in the claim.
Measure K funds identified in this claim are not being used in place of developer funds.
The agency certifies, as a condition of eligibility for non-competitive bicycle funds for this project, that it can
be completed or constructed within five (5) years.
The agency will cause work to be commenced on the project within a reasonable time after approval of a
Measure K Bicycle Program claim form. The claim form will be used in lieu of a contract. Successful
claimants will encumber allocated non-competitive funds by no later than the end of the fiscal year following
the funding cycle designated on Claim Form 1, or have them set aside as requested in the claim.
The agency will comply where applicable with provisions of the California Environmental Quality Act, the
American with Disabilities Act, and any other applicable federal, state and/or local laws and/or regulations.
I certify that the information contained in this claim, including attachments, is accurate to the best of my

A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE
CITY MANAGER TO SIGN ASSURANCES TO THE SAN JOAQUIN
COUNCIL OF GOVERNMENTS (COG) RELATIVE TO THE LODI
LAKE BICYCLE PATH PROJECT (PHASE II)

WHEREAS, the City of Lodi is building a bike path at Lodi Lake; and
WHEREAS, the City of Lodi intends to construct the bike path at Lodi Lake using
in part Measure K Bicycle Program money; and
WHEREAS, the City of Lodi is requesting from the San Joaquin Council of
Governments Measure K Bicycle Program money to construct the Lodi Lake Bicycle
Path Project (Phase II).
NOW, THEREFORE, BE IT RESOLVED, that the Lodi City Council hereby
authorizes the City Manager to sign Assurances to the San Joaquin Council of
Governments relative to the Lodi Lake Bicycle Path Project (Phase II).
