HomeMy WebLinkAboutAgenda Report - October 17, 2001 E-13AGENDA TITLE: Adopt Resolution, Approve the Application to Apply for Grants Funds from the Roberti-Z'Berg-Harris Urban Open Space and Recreation Program under the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000 for Improvements to Lodi Lake Park Central (Southwest) Area and Authorize the City Manager to Sign Local Match Certificate Form and Waiver Request Form MEETING DATE: October 17, 2001 PREPARED BY: Parks and Recreation Director RECOMMENDED ACTION: That the City Council adopt the attached resolution, approve the application to apply for grants funds from the Roberti-Z'Berg-Harris Urban Open Space and Recreation Program under the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000 for improvements to Lodi Lake Park central (southwest) area and authorize the City Manager to sign the local match certificate form and waiver request form. BACKGROUND INFORMATION: In order for the City to apply for the above-mentioned grant, Council must approve the attached resolution, grant application, approve certification that the 30% match requirement is available, and request for waiver of the 10% private or non -state match attached. Staff has identified improvements to the southwestern section of the central area of Lodi Lake for a State of California competitive grant. This grant program is part of the Roberti-Z'Berg-Harris Urban Open Space and Recreation Grant Program. These grants are competitive and based upon scoring on a number of criteria. Award of successful grants is expected to be announced this coming Spring. Grants under this program are intended for high priority projects that satisfy the most urgent parks and recreation needs. Collaboration (partnerships) on projects is encouraged. Eligible projects include 1) acquisition; 2) development/rehabilitation; 3) special major maintenance; and 4) innovative recreation programs. The proposed project is consistent with the City's Parks, Recreation, and Open Space Master Plan. The entire southern area was identified for improvements in our City budget process and is listed as a priority. This grant application, if successful, will allow us to move forward with improvements to the western area as indicated on the attached site map. Staff estimates the total project costs in this application to be $245,714. The match is $73,714. Also, please note that 10% ($24,571) of the match must come from private or non -state sources unless a waiver is requested. Staff recommends approval to request this waiver. This plan was approved by the Lodi Parks and Recreation Commission and Lodi City Council in 1994. Improvements will highlight and facilitate outdoor use of the Lodi Lake facility. Specifically, old asphalt will be removed and a new parking lot configuration will be constructed at the western edge of the existing parking lot area. These improvements will include clearing and grubbing, grading, installation of underground utilities, concrete work, irrigation and landscaping, and placement of park amenities. These improvements will aid the public in accessing and utilizing this unique outdoor facility for activities such as swimming at the beach area and accessing a bicycle/pedestrian walking trail. The parking will also support use of the Lodi Lake Discovery Center. For Dev. In our estimation we would be unsuccessful in raising funds for the private or nonstate match because the proposed project is of a nature not likely to attract private or nonstate funds or contributions. The project consists of improvements of existing support facilities. Our community is extremely supportive of Lodi Lake and improvements of this nature do not lend themselves to fund raising. The 30% Match can not come from state sources, such as other state funded grant programs (Per Capita, Habitat Conservation Fund, Urban Centers, Non -Motorized Trails, etc.). Any combination of the above RZH Urbanized Area Procedural Guide 10 Criteria for Waiver of Match Waiver Conditions for 10% Private or Nonstate Match (Acquisition and Development Projects) Grantees may request a waiver of the 10% private or nonstate Match. With a waiver, the Grantee is still responsible for a 30 percent local Match, but will not be required to certify that one-third of this 30 percent Match is from Private or Nonstate Sources. It is recommended that this request for waiver be submitted in narrative form to the Department. It may be submitted at the same time the Grantee submits the Project Application. The Applicant's matching money from Private or Nonstate Sources shall not be required if the Local Agency can comply with Item A and Items B or C (i.e. A and B or A and C). A. The Applicant currently has available the entire 30% in other eligible matching funds in the event the private or nonstate Match is waived (certification required). AND B. There has been an unsuccessful attempt to raise private or obtain nonstate matching funds or contributions for the proposed Project or similar Projects (submit evidence); OR C. An attempt to raise funds would, in the estimation of the Applicant, be unsuccessful for two or more of the following reasons: 1. The availability of financial assistance from Private or Nonstate Sources for the Project is limited (submit statement); 2. The per capita income in the Applicant's Jurisdiction is lower than the statewide average (submit evidence); 3. The unemployment rate in the Applicant's Jurisdiction is above the statewide average (submit evidence); 4. Plant or business closure in the Applicant's Jurisdiction has accelerated in the past two years (submit evidence); 5. The proposed Project is of a nature not likely to attract private or nonstate funds or contributions. This includes, but is not limited to, replacement Projects of existing support facilities (restrooms, parking, irrigation systems, water supply, drainage), site preparation for new developments (grading, utility, fencing), and Acquisition Projects such as in -holdings, easements, and boundary adjustments. BUS SHELTER 1 EA 35,000.00 35,000.00 SUB -TOTAL: $219,177.00 2% PUBLIC ART COST: $4,383.54 CONTINGENCY: $22,153.46 PROJECT TOTAL: $245,714.00 RESOLUTION NO. 2001-239 A RESOLUTION OF THE LODI CITY COUNCIL APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE ROBERTI-Z'BERG-HARRIS URBAN OPEN SPACE AND RECREATION PROGRAM UNDER THE SAFE NEIGHBORHOOD PARKS, CLEAN WATER, CLEAN AIR, AND COASTAL PROTECTION BOND ACT OF 2000, FOR THE LODI LAKE PARK CENTRAL (SOUTHWEST) AREA IMPROVEMENTS, AND FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE LOCAL MATCH CERTIFICATE FORM AND WAIVER REQUEST FORM WHEREAS, the people of the State of California have enacted the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000, which provides funds for the Roberti-Z'Berg-Harris Open Space and Recreation Program; and WHEREAS, the Legislature of the State of California has enacted the Roberti-Z'Berg- Harris Open Space and Recreation Program, which provides funds to certain political subdivisions of the State of California for acquiring lands and for developing facilities to meet urban recreational needs; and WHEREAS, the California Department of Parks and Recreation has been delegated the responsibility for the administration of the grant program, setting up necessary procedures; and WHEREAS, said procedures established by the California Department of Parks and Recreation require Applicant's Governing Body to certify by resolution the approval of the Application before submission of said Application to the State; and WHEREAS, the Applicant will enter into a Contract with the State of California for the Project. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council hereby: Approves the filing of an Application for local assistance funds from the Roberti-Z'Berg- Harris Urban Open Space and Recreation Program under the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000; and 2, Certifies that the Applicant has or will have sufficient funds to operate and maintain the Project, and further authorizes the City Manager to execute Local Match Certificate Form and Waiver Request Form; and 3. Certifies that the Applicant has reviewed, understands, and agrees to the General Provisions contained in the Contract shown in the Procedural Guide; and 4. Appoints the Lodi Parks and Recreation Director as agent to conduct all negotiations, execute and submit all documents including, but not limited to, Applications, agreements, payment requests and so on, which may be necessary for the completion of the Project(s).
