HomeMy WebLinkAboutAgenda Report - November 21, 2001 E-17AGENDA TITLE: Adopt Resolution Accepting Public Water Main Improvements at 1055 South Lower Sacramento Road MEETING DATE: November 21, 2001 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council adopt a resolution accepting the public water main improvements at 1055 South Lower Sacramento Road. BACKGROUND INFORMATION: Improvements in the public water main at 1055 South Lower Sacramento Road have been installed in substantial conformance with the requirements of the Improvement Agreement between the City of Lodi and The Protestant Episcopal Bishop of San Joaquin, as approved by the City Manager on May 17, 2001, and as shown on Drawings 000D012 and 000D013. The water main improvements are installed in the St. John's parking lot and the final lift of asphalt pavement has not been placed on the parking lot. There are three public water valve boxes that cannot be installed until the asphalt work is completed. In order to have the project accepted by Council before the water valve boxes are adjusted to grade, the contractor for this project has provided the City with a cash deposit. This cash deposit will be returned to the contractor when the work is completed, or used by the City to have another contractor perform the work. FUNDING: Not applicable. Richar C. Box 3006 Lodi, CA 95241-1910 RESOLUTION NO. 2001-265 A RESOLUTION OF THE LODI CITY COUNCIL ACCEPTING THE DEVELOPMENT IMPROVEMENTS INCLUDED IN THE IMPROVEMENT AGREEMENT FOR PUBLIC WATER MAIN IMPROVEMENTS AT 1055 SOUTH LOWER SACRAMENTO ROAD The City Council of the City of Lodi finds: That all requirements of the Improvement Agreement between the City of Lodi and The Protestant Episcopal Bishop of San Joaquin, for the Public Water Main Improvements at 1055 South Lower Sacramento Road, have been substantially complied with. The improvements are shown on Drawing Nos. 000DO12 and 000DO13 on file in the Public Works Department, and as specifically set forth in the plans and specifications approved by the City Manager on May 17, 2001. Public Works Director The City Council of the City of Lodi, at its meeting on Wednesday, November 21, 2001, accepted the public improvements in the subject project. A copy of the resolution is enclosed for your files. This letter constitutes notice to you that the subject Certificate of Deposit, dated May 10, 2001, in the amount of $20,500 to guarantee faithful performance has now been reassigned to Episcopal Church of St. John the Baptist. The City of Lodi no longer has an interest in this Certificate of Deposit. Certificate of Deposit No. 68728, dated May 10, 2001, in the amount of $10,250 to guarantee labor and materials will be reassigned February 19, 2002, ninety days from the date of acceptance of the improvements in conformance with State law. Public Works Director The City Council of the City of Lodi, at its meeting on November 21, 2001, accepted the public improvements that were made in the subject project. Enclosed for your files is a copy of the resolution accepting the public improvements. From the date of the resolution, the City of Lodi will maintain the street and other public improvements installed within rights-of-way and public utility easements as shown on the approved plans. The Certificate of Deposit assigned to the City to guarantee faithful performance can now be reassigned to you. The Certificate of Deposit guaranteeing labor and materials will have to remain in effect for a period of ninety days from the date of the resolution in conformance with State law. Your representative can pick up these reassignments and certificates at our office during normal working hours.
