CITY OF LODI COUNCIL COMMUNICATION AGENDA TITLE: Adopt Resolution Confirming The Election And Appointment Of Members To The Project Area Committee For The Lodi Redevelopment Project No. 1 MEETING DATE: November 7, 2001 PREPARED BY: City Clerk RECOMMENDED ACTION: That the City Council adopt a resolution confirming the election and appointment of members to the Project Area Committee (PAC) for the Lodi Redevelopment Project No. 1. BACKGROUND INFORMATION: At the meeting of September 5, 2001, the City Council adopted Resolution Nos. 2001-214 and 2001-215 approving and adopting the procedures for the election of members to and the procedures for the formation of a PAC. At that meeting the City Council directed the City Clerk's Office to conduct the election of members to the PAC, and the subject election was held on Tuesday, October 16, 2001 from 8:00 a.m. — 7:00 p.m. A total of 80 ballots were cast and then counted at the close of the election. The members elected to the PAC are shown on Exhibit A. Staff recommends that the East Side Improvement Committee (Exhibit B) be appointed to serve on the PAC representing the category of Existing Community Organization. Prior to the first meeting of the PAC, the East Side Improvement Committee shall designate one person to serve as the representative PAC member for the organization. It is, therefore, recommended that the City Council adopt a resolution confirming the election and appointment of members to the PAC for the Lodi Redevelopment Project No. 1. Dixon Flynn -- Ciryanager RESOLUTION NO. 2001-254 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODI CONFIRMING THE ELECTION AND APPOINTMENT OF MEMBERS TO THE PROJECT AREA COMMITTEE FOR THE LODI REDEVELOPMENT PROJECT NO. 1 WHEREAS, pursuant to the California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.), the Redevelopment Agency of the City of Lodi (the "Agency") is preparing a proposed Redevelopment Plan (the "Redevelopment Plan") for the Lodi Redevelopment Project No. 1 (the "Project"); and WHEREAS, Section 33385(a) of the Community Redevelopment Law requires that the legislative body, under certain circumstances, call upon the residents and existing community organizations in a redevelopment project area to form a project area committee; and WHEREAS, by Resolution No. 2001-215, adopted on September 5, 2001, the City Council of the City of Lodi (the "City Council") determined that a project area committee shall be formed for the Project and approved and adopted "Procedures for the Formation of a Project Area Committee for the Lodi Redevelopment Project No. 1" (the "PAC Formation Procedures"); and WHEREAS, by Resolution No. 2001-214, adopted on September 5, 2001, following a duly noticed public hearing, the City Council approved and adopted "Procedures for the Election of Members to Project Area Committees in the City of Lodi" (the "PAC Election Procedures"); and WHEREAS, pursuant to the PAC Formation Procedures and the PAC Election Procedures, on October 16, 2001, the Agency held an election of Residential Owner - Occupant, Residential Tenant, Business Owner -Tenant and Business Owner -Property Owner members to the Project Area Committee for the Project; and WHEREAS, in accordance with the PAC Formation Procedures, the City Council is authorized to appoint one (1) Existing Community Organizations to serve on the Project Area Committee for the Project; and WHEREAS, on November 7, 2001, the Agency reported the results of the Project Area Committee election to the City Council. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LODI DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The City Council hereby announces that the persons and entities identified on Exhibit A hereto have been elected to serve as members of the Project Area Committee for the Lodi Redevelopment Project No. 1. Section 2. The City Council hereby appoints the Existing Community Organization identified on Exhibit B hereto to serve on the Project Area Committee for the Project. Prior to the first meeting of the Project Area Committee, the Existing Community Organization so appointed shall designate one person to serve as the representative PAC member for that organization in accordance with the PAC Formation Procedures. Section 3. The City Council hereby finds that the PAC Election Procedures were followed for the election of members to the Project Area Committee for the Project.
