AGENDA TITLE: Adopt Resolution Rejecting Lowest Bid for Armory Park Bleacher Improvements, 333 N.
Washington Street, and Award Bid to Next Lowest Responsible Bidder, Benton Fence and
Drilling, of Galt ($83,570.00)

RECOMMENDED ACTION: That the City Council adopt a resolution rejecting the lowest bid for the above
project and award the bid to the next lowest responsible bidder, Benton Fence and
Drilling of Galt, in the amount of $83,570.00 and appropriate funds in accordance
with the recommendation shown below.
BACKGROUND INFORMATION: In September of 1999, Council approved the installation of new bleachers
for the Softball Complex. The project was funded through 1998/99
Community Development Block Grant dollars in the amount of $50,000.
The project total for the Softball Complex scope of work was $56,196.29
with the additional funds coming from Parks and Recreation Capital Improvement funds. The scope of work for this
project was to provide and install (1) 30 -foot five -tier bleacher and (1) 27 -foot five -tier handicap accessible bleacher
with ramps.
For the Armory Bleacher project, we used the some Request for Proposal outline, the only difference was that the
Armory bleachers were to be (2) 27 -foot five tier handicap accessible elevated portable bleachers with ramps. The
specified bleachers are to accommodate wheelchair seating with safety guard railing that meets the 1997 Uniform
Building Codes (UBC) and National Fire Prevention Association (NFPA) requirements. All bleacher components are
to consist of understructure frames (no more than six feet on center), extruded aluminum alloy seat planks and foot
planks, ramps, walkways, aluminum end caps, tubular extruded aluminum alloy guardrail system, and other
incidental and related work detailed in the Request for Proposal.
The Parks Division staff used the same $50,000 estimate for the Armory project because staff felt the reduction in
one bleacher size would off -set the price to meet the project budget. Staff spoke with the contractor (Benton Fence
and Drilling was the only responsible bidder) regarding the increase cost of the bleachers. Mr. Benton indicated that
his labor had increased approximately $450.00 from 1999 but that the major increase was in the bleachers
themselves.
Request for Proposals for this project was approved on August 15, 2001. The City received the following two bids
for this project:

Staff is recommending that the Southeastern Seating bid be rejected due to guardrail material not meeting
specifications. Staff requests the reallocation of $34,000 from the 2000/01 CDBG Walnut Street Park Lot Project,
which has been cancelled.

RESOLUTION NO. 2001-258
A RESOLUTION OF THE LODI CITY COUNCIL REJECTING THE
LOWEST BID FOR ARMORY PARK BLEACHER IMPROVEMENTS,
333 N. WASHINGTON STREET, AND AWARDING THE BID TO
THE NEXT LOWEST RESPONSIBLE BIDDER, AND FURTHER
APPROPRIATING FUNDS FOR THIS PROJECT
WHEREAS, in answer to notice duly published in accordance with law and the order of
this City Council, sealed bids were received and publicly opened on September 19, 2001 at
11:00 a.m. for Armory Park Bleacher Improvements, 333 N. Washington Street, described in
the Request for Proposal therefore approved by the City Council on August 15, 2001; and
WHEREAS, said bids have been compared, checked, and tabulated and a report
thereof filed with the City Manager as follows:

WHEREAS, the City Manager recommends rejecting the low bid from Southeastern
Seating, Inc., for the Armory Park Bleacher Improvements, 333 N. Washington Street, and
further recommends awarding the bid to the next lowest responsible bidder, Benton Fence and
Drilling, of Galt, CA, in the amount of $83,570.00.
NOW, THEREFORE, BE IT RESOLVED, that the Lodi City Council does hereby reject
the lowest bid for the Armory Park Bleacher Improvements, 333 N. Washington Street, and
hereby awards the same to Benton Fence and Drilling, of Galt, CA, the lowest responsible
bidder, in the amount of $83,570.00; and
BE IT FURTHER RESOLVED, that funds be appropriated as follows:
2001/02 CDBG Funds (account to be established) $50,000.00
Reallocation of 2000/01 CDBG Funds (account 456508) $34,000.00
