HomeMy WebLinkAboutAgenda Report - October 11, 19944 w • i CITY OF LODI COUNCIL COMMUNICATION AGENDA TITLE: Improvement Agreement Addendum for Century Meadows One, Unit No. 1 MEETING DATE October 19,1994 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council approve the Improvement Agreement Addendum for Century Meadows One, Unit No.1, Tract No. 2570, and direct the City Manager and City Clerk to execute the Improvement Agreement Addendum on behalf of the City. BACKGROUND INFORMATION: The Developer, Lewis Homes of California, entered into an improvement agreement with the City on May 11, 1994 for construction of the public improvements for the Century Meadows One, Unit No. 1 subdivision. The construction of a reverse frontage fence along the Century Boulevard frontage of Lot 1 was included in the agreement (see attached Exhibit A). The Developer is currently constructing a model complex for the subdivision on the Tots immediately south of Lot 1. On September 28, 1994, the Developer requested that the construction of the reverse frontage fence be postponed to allow an unobstructed view of the model complex from Century Boulevard. Staff felt this was a reasonable request as long as a time limit was established and improvement security provided for the construction of the fence. The Developer has indicated to staff that Lot 1 will be landscaped and left vacant until the subdivision is dosed out. For this reason, it seemed reasonable to tie the construction of the fence to the development of Lot 1 as well as a maximum time limit to account for unexpected delays in buildout of the subdivision. Lewis Homes of Califomia has furnished the City with the necessary improvement agreement addendum and improvement security ($7,000) to allow the postponement of the construction of the reverse frontage fence. Staff recommends that Council accept the addendum and allow the acceptance of the balance of the subdivision improvements prior to construction of the fence. FUNDING: Provided by Developer.
