Exemption

RECOMMENDED ACTION: That Council review and approve the attached amended
Resolution 94-123 and Notice of Exemption.
BACKGROUND INFORMATION: At the meeting of October 5, 1994 Council adopted
Resolution No. 94-117 approving the City of Lodi as
a co -applicant in the submittal of a Recycling
Market Development Zone (RMDZ) application. Staff
has learned the four underlined sections on the attached amended resolution are.
required by the Integrated waste Management Board. in addition, the attached
Notice of Exemption also requires Council approval. Future specific projects
undertaken in the RMDZ (in Lodi or elsewhere) will be subject to CEQA
environmental review. Depending on proposed project location, size and scope,
uses proposed and project setting, the environmental review could be in the
form of a categorical exemption, negative declaration, SIR, or a focussed or
addendum EIR. The RMDZ itself however, is categorically exempt from CEQA.

APPROVING RECYCLING MARABT DEVSLOPMSNT ZONE APPLICATION
AND AUTHORIZING STAFF TO SUBMIT APPLICATION TO THE
CALIFORNIA INTEGRATED NAM MAN GXMW BOARD

WHEREAS, the California Public Resources Code provides for the
establishment of a Recycling Market Development Zone Program throughout
the State which provides incentives to stimulate development of
secondary materials markets; and
WHEREAS, the designation of a sone in the cities of Sscalon,
Lathrop, Lodi, Manteca, Ripon, Stockton, Tracy and the unincorporated
portion of San Joaquin County, dedicated to the expansion of secondary
materials business enterprises is essential for market development and
to assist in meeting landfill reduction goals; and
WHEREAS, the development of local markets for recycled materials
would reduce the need to transport them out of the region in the
future; and
WHEREAS, the cities of Recalon, Lathrop, Lodi, Manteca, Ripon,
Stockton, Tracy and the unincorporated portion of San Joaquin County
will be co -applicants in the submittal of this Recycled Market
Development Zone Application to the California Integrated Waste
Management Board;
NOW, THEREFORE, BE IT RESOLVED, that, the Lodi City Council hereby
approves submittal of a Recycling Market Development Zone Application;
and
1. raves the submittal of a Recycling Market Development Zone
plication. which includes a sone area that is equivalent to the
physical boundaries of San Joaquin County.
2. That the proposed zone is necessary to assist i attracting
private sector business investments tg the proposed zone.
3. That the current and proposed waste management practices and
cgnditions are, and will be. favorable to the 'development of
post -consumer waste materials markets.
4. With regard to environmental clearance. it is determined that
this proiect is categorically exempt from the requirements of CEOA
Guidelines (Cal_ Code of Ream.. Section 15320 Class 20)The pr000ggd
zone will have no negative environmental impact on the area.
BE IT FURTHER RESOLVED, the City Manager and City Clerk are
hereby authorized to execute said agreement on behalf of the City of
Lodi.
