Public Hearing to Consider Resolution/Order to Vacate Three On -Site Public Utikty Easements at 600 and 610 West Lodi Avenue MEETING DATE September 7, 1994 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council, after hearing input from property owners, take the appropriate action on this proposed abandonment BACKGROUND INFORMATION: The 5 -foot and 8 -foot easements at 600 and 810 West Lodi Avenue have existing utilities that provided services to structures that have been and will be demolished (Mandarin Restaurant and Central Sierra Bank). The 10 -foot and 7 -foot easements have never been used. The locations of the easements are shown on the attached exhibit The developer of the properties will dedicate easements and relocate any necessary services required for future development. The Planning Commission, at their August 8, 1994 meeting, made the determination that there was no public need for the easements and recommended abandonment. FUNDING: Not applicable. September 7, 1994 at the hour of 7:00 p.m., or as soon thereafter as the matter may be heard, the City Council will conduct a Public Hearing to consider the following matter: a) Intention to abandon three on-site easements at 600 and 810 West Lodi Avenue. This matter was referred to the Planning Commission and will appear on its agenda of August 8, 1994. All interested persons are invited to present their views and comments on this matter. Written statements may be filed with the City Clerk at any time prior to the hearing scheduled herein, and oral statements may be made at said hearing. If you challenge the subject matter in court, you may be limited to raising only those issues you or someone else raised at the Public Hearing described in this notice or in written correspondence delivered to the City Clerk, 221 West Pine Street, at or prior to the Public Hearing. Lodi. Ch) and on February 29. 1988 (610 West Lodi Avenue. Lodi.CA), there was dedicated easements for public utilities located at 600 and 610 West Lodi Avenue, Lodi, more particularly described as follows and delineated on the attached map: 610 W. Lodi Avenue - Instrument 688018774 610 W. Lodi Avenue - Book of Official Records Vol. 4364, Pg. 614 600 W. Lodi Avenue - Book of Official Records Vol. 4364, Pg. 612; and WHEREAS, requested that WHEREAS, relocated and ent; and the developers of 600 and 610 West Lodi Avenue, have the City of Lodi abandon such easements; and such neceseary e*sement0 and facilities will be there are no other Public facingss located within the WHEREAS, the Streets and Highways Code of the State of California, Sections 8330 and 8333 provide that the legislative body of a local agency may summarily vacate a public service easement if the easement have been_ superseded by reloceyion and there are no other public facilities located within the easement; and WHEREAS, pursuant to the requirements of Government Code Section 27288.1, the name of the owner of the title or interest in 600 and 610 West Lodi Avenue as it appeared at the time and in the document creating the interest, right or encumbrance is as follows: Harry L. Bader, et al Connie Dewalt Bank of America, National Trust & Savings Association WHEREAS, in accordance with Streets and Highways Code Section 8300 et seq., it is the desire of the City Council of the City of Lodi to vacate such easements. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lodi as follows: That the public utility easements located at 600 and 610 West Lodi Avenue be vacated; and RES94103/TXTA.02J That from and after the date this resolution is recorded, such easements will no longer constitute public service easements.
