OF CITY OF LODI LINCIL 'COMMUNICATION AGENDA TITLE: Request From Mohebull Ahmadi to Operate a Hot Dog Cart on the Sidewalk Fronting 225 W. Elm Street MEETING DATE: September 7, 1994 PREPARED BY: City Manager RECOMMENDED ACTION: That the City Council consider the request (Exhibit A) of Mr. Mohebull to operate a hot dog stand on the sidewalk fronting 225 W. Elm Street (Municipal Court Building). BACKGROUND INFORMATION: Lodi Municipal Code Section 10.44.80 prohibits the parking of lunch wagons, eating carts, etc., on any portion of the public righ• -of -way without obtaining a written permit from the City Council. The permit is to designate the specific location and conditions under which such cart shall be allowed to stand. Mr. Mohebull Ahmadi has requested a permit to operate a hot dog cart on the sidewalk ill front of the Municipal Court building located at 225 W. Elm Street. Mr. Ahmadi will sell hot dogs, water, gum, ice cream and sodas and will operate Monday - Friday between 8:30 a.m. and 4:00 p.m. City staff contacted the following individuals to discuss concerns and questions regarding this request: - Thomas Seibly - Municipal Court Judge - Camy Joerke - Deputy Court Administrator, San Joaquin County - Richard Callistro - Capital Projects Manager, San Joaquin County The only issues raised by those contacted concerned trash on the sidewalk and the possibility of people bringing food into the court and the lobby. The encroachment permit can require the vendor to be responsible for litter and to provide a trash receptacle. The County would be responsible for prohibiting food from being brought into the building which could be accomplished by posting a sign on the front door to the building. Elm Street September 7, 1994 Page Two Staff recommends that the encroachment permit be issued with the following conditions: The specific location of the cart be designated so that a minimum of 3.5 feet of unobstructed passage is provided for sidewalk pedestrian traffic; The term of the permit is to be one year; • The owner of the cart is to be responsible for removing litter from the area; ° Hours of operation are to be 8:30 a.m. - 4:00 p.m., and ° The City of Lodi retains the authority to revoke the permit at any time.
