AGENDA TITLE: Request for Sidewalk Replacement and Other Improvements
in the 500 Block of East Oak Street
MEETING DATE: April 6, 1994

RECOMMENDED ACTION: That the City Council discuss the request for sidewalk replacement and
other improvements in the 500 block of East Oak Street and take
appropriate action.
BACKGROUND INFORMATION: The attached letter from Mr. Christopher Kosta (Exhibit A)
requests that the City Council consider the installation of additional
improvements in the 500 block of East Oak Street over and above
those improvements which were already planned fronting
501 East Oak Street and a portion of 505 East Oak Street. The attached Exhibit B shows the
northeast comer of Oak and Garfield streets. The City's plan was to construct a new return with
handicap ramp and side -inlet catch basin and to replace approximately 77 lineal feet of sidewalk
fronting 501 and 505 East Oak Street. The sidewalk is being replaced under the City's Sidewalk
Replacement Program due to the vertical offsets caused by the Magnolia and Liquid Amber trees in the
area. The City is installing a catch basin at this comer to pick up a portion of the surface water which
presently flows from Cherokee Lane westerly down Oak Street and then northerly down Garfield to a
catch basin at Pine Street.
The following is a discussion of each of Mr. Kosta's requests:
Replace all sidewalk - Mr. Kosta is requesting that the sidewalk in front of his property
at 509 East Oak Street and 20 feet of the sidewalk in front of 505 East Oak Street be
replaced. This would then provide for all new sidewalk from Garfield Street to
Cherokee Lane. The City's policy on curb, gutter and sidewalk repair is attached as
Exhibit C. Under this policy, the City will only replace sidewalk when the vertical
offset is greater than 1 1/2 inches. Sidewalk displacements of 3/4 inch to 1 1/2
inches are handled with temporary patching. The additional sidewalk which Mr. Kosta
is requesting be replaced has no vertical offsets but does have minor cracking. This
sidewalk does not meet the policy for replacement nor does it even require temporary
patching. This sidewalk is safe and usable in its present condition.

The existing sidewalk fronting 501, 505 and 509 East Oak Street is 6 feet in width.
Any replacement sidewalk would go back in at the City's standard 5 -foot width. If the
City were to replace the older sidewalk fronting 505 and 509 East Oak Street, it
would be recommended that the 18 -foot section of newer sidewalk fronting
505 East Oak Street also be removed and replaced to the 5 -foot width. The cost of
this sidewalk replacement for these two parcels is as follows:

Since this older sidewalk does not meet the City's policy for replacement, it is
recommended that this request not be granted. With the removal of the Liquid Amber
trees fronting Mr. Kosta's property, his existing sidewalk should remain safe and
usable for many years.
2. Add storm drain connection at Garfield and Oak - The City will be adding a catch basin at this
location and tying it into the existing 24 -inch storm drain in Garfield.
3. Replace curb from Garfield to 509 East Oak Street - Exhibit D shows the profile of the flow
line in the curb and gutter fronting 501, 505 and 509 East Oak Street. Installing the curb and
gutter and a catch basin at the comer of Garfield and Oak will appreciably reduce the flooding
fronting 509 East Oak Street. The minor deviations in the flow line grade fronting 505 and
509 East Oak Street do not warrant the removal and replacement of the curb and gutter. The
flow line of the nes: catch basin at the comer is being set so that if this curb and gutter needs
to be replaced in the future, sufficient grade exists in order to increase the slope in the new
flow line.
4. Removal and replanting of trees - The City will be removing the Liquid Amber trees fronting
509 East Oak Street and will provide for replanting under the City's 1995 spring Tree Planting
Program.

My name is Christopher Kosta I live a 509 E. Oak St. Lodi.
Ca 95240. 1 am writing to you for the repairs to the
sidewalk that you are going to start on the five hundred
Flock of East Oak street. The sidewalk from cheeokey to 509
li. Oak is new. Your repairs are going from Garfield to 511
E. Oak leaving fifty feet of the side walk not repaired.
Also there is a problem of drainage of water on the five
hundred block of Oak St. I am asking that the city do the
following:
I. Replace all of the side walk
2. Add a strom connection at the corner of
Garfield and Oak St.
3. Replace the crub from Garfield to 509
East Oak St.
4. Remove the trees and replant new trees
That will not damage the sidewalk

CURB, GUTTER & SIDEWALK
REPAIR POLICY
Property owners or tenants have the responsibility to report to the City of
Lodi all defective sidewalk fronting their property.
I. SIDEWALK REPAIR
A. TEMPORARY PATCHING - The City shall patch sidewalk where there is
vertical offset or minor irregularities. This will be
done at no charge to the property owner. The property owner or
tenant has the responsibility to notify the City of any change in the
condition of the sidewalk or the patched area.
B. SIDEWALK REPLACEMENT - Sidewalks shall be removed and replaced when
vertical offset is greater than 1 1/2."
1. Sidewalk and driveway apron replacement will be done by City
under the following conditions:
a. Damage caused by City -maintained trees
b. Damage due to grade subsidence
c. Damage due to City utility cuts
d. Damage due to heat expansion
e. Sidewalk fronting City -owned property
2. Property owner shall replace sidewalk and driveway apron where
the hazardous condition is caused by something other than the
above categories,. The property owner shall have a licensed
contractor do the work within a prescribed time. If, after
formal notice by the City, the repairs are not completed within
that time, the City shall make the repairs and assess the
property owner.
II. CURB AND GUTTER REPAIR
A. The City shall repair and maintain all curb and gutter.
III. TREE MAINTENANCE
A. The City shall do root surgery on all City -maintained trees where it
is required. City shall remove City -maintained trees when required
under City's adopted Tree Policy. This work will be done in
conjunction with the replacement of the sidewalk and/or the curb and
gutter.
B. The City shall not do root surgery on any privately -owned trees.

Subject: Meeting Notification to Property Owner at 509 East Oak Street
Council Member Davenport, at the last regular Council Meeting of April 6, 1994,
indicated that Mr. Kosta had indicated to him that %.ity staff had provided him with the
incorrect date for the Meeting at which time his request was to be heard.
Enclosed are copies of two letters informing Mr. Kosta that his item would be re -placed
on the agenda of April 6, 1994. In addition to these two letters, I personally talked to
Mr. Kosta on March 17, 1994, indicating that his item was pulled off of the agenda due
to the lateness of the hour and would be reagendized. And, as indicated by the
City Clerk at the last Council Meeting, she had talked with Mr. Kosta in her office on
March 17, 1994, and informed him of the April 6 Council Meeting date.

Per our conversation this morning, l am providing you with copies of the plan showing
the location of the catch basin at the intersection of Garfield and Oak together with the
cub profile on Oak Street As I indicated, this item will be re -placed on the agenda of
the April 6, 1994 Council meeting. I will be providing you with a copy of our Council
Communication and recommendation related to your request as soon as it is prepared.
Pve also enclosed a copy of the Curb, Gutter and Sidewalk Repair Policy which shows
that we would not normally remove or replace any sidewalk unless the vertical offset
was greater than one and one-half incites. The sidewalk fronting your property
appears to have no vertical offsets-, however, theca is some cracking which we feel is
not a hazard to the public.

The City Council, at its regular meeting of April 6, 1994, approved a portion of your
request for the installation of a storm drain side -inlet catch basin at the intersection of
Oak and Garfield and the removal of all of the remaining Liquid Amber trees on the
north side of the 500 block of East Oak Street. The City, as part of its 1995 Spring
Tree Planting Program, will replant more appropriate trees in the parkway. The City
Council did not approve your request for the sidewalk replacement fronting your
property nor did they approve any additional curb and gutter replacement on the north
side of the 500 block of East Oak Street.
As pointed out in our Council Communication, the installation of the catch basin, and
the replacement of the curb and gutter around the comer curb return, will appreciably
reduce the flooding and the water standing in the curb and gutter fronting your parcel
and the property to the west of your parcel.
