HomeMy WebLinkAboutAgenda Report - June 15, 1994 (42)or CITY OF LODI cfli � COUNCIL COMMUNICATION AGENDA TITLE: Ordinance Amending Lodi Municipal Code Chapter 5.40.020 Defining Adult Businesses MEETING DATE: June 15, 1994 PREPARED BY: City Attorney RECOMMENDED ACTION: Introduce Ordinance No. 1595 amending Lodi Municipal Code Chapter 5.40.020 defining adult businesses. BACKGROUND INFORMATION: Pursuant to the request of the Council, the attached draft ordinance would modify Municipal Code 55.40.020 (4) to include "juice bars." This type of business has recently sprung up in the area and involves establishments offering nude or topless entertainment in places where no alcohol is served. Patrons purchase or are served soft drinks or juice only, and the businesses do not have to cope with regulations applicable to places where alcohol is sold. Although the ordinance as presently worded would probably cover such activities by inference, it may be desirable to explicitly include in the ordinance's reach dinner theaters or other places where food and/or beverages (other than alcohol) are served. This is intended as a preventive measure only, since I am unaware of any similar uses presently being conducted in the City, or pending applications for such businesses. FUNDING: Not applicable. Chapter 5.40 Regulation of Business Licenses - is hereby amended at paragraph 4 of Section 5.40.020 defining "Adult Theater", to read as follows: 4. "Adult theater" means any commercial theater,•dinner theater or other establishment where food and/or Leverages are served, or other place of business which presents live entertainment, closed circuit television, video tapes, films or slides more than twenty-five percent of which are characterized or distinguished by emphasis on matter depicting or describing specified sexual activities or specified anatomical areas. SECTION 2. All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. SECTION 3. This ordinance shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage and approval. -1- Approved this day of JACK A.
