HomeMy WebLinkAboutAgenda Report - June 21, 1995 (63)� of CITY OF LODI COUNCIL COMMUNICATION C4�IF 13��P AGENDA TITLE: Resolution Stating Opposition to State Assembly Bill 318 MEETING DATE: June 21, 1995 PREPARED BY: City Manager RECOMMENDED ACTION: That the City Council adopt Resolution No. 95-77, "A Resolution of the Lodi City Council Expressing Opposition to Assembly Bill 318." BACKGROUND INFORMATION: Assembly Bill 318 is being sponsored by Assemblyman Richard Katz of Southern California. The bill would restrict the ability of cities to transfer revenue from their electric and water utilities to the city's General Fund. The bill has passed the Assembly (the City's Assemblyman, Larry Bowler, voted in favor over the City's expressed opposition) and is now in Senate committees. Passage of this bill would have a catastrophic effect on the day-to-day operations of the City of Lodi. It would reduce the City's General Fund revenue by $4.72 million, approximately 25%. In that event, no City service would be spared significant reductions in funding, including police and fire. This bill represents a serious intrusion by the State into local rate setting authority. It is a textbook illustration of the State's continuous meddling into the affairs of local government. It is recommended the City Council join with the League of California Cities, the Northern California Power Agency (NCPA) and others in vigorously opposing this bill. PETERSON ko City Manager CC -1 tap JXWCOUNCIL1AB318MOC RESOLUTION NO. 95-77 A RESOLUTION OF THE LODI CITY COUNCIL EXPRESSING OPPOSITION TO ASSEMBLY BILL 318 WHEREAS, Assembly Bill 318, being sponsored by Assemblyman Richard Katz (D - Sylmar); and WHEREAS, this bill restricts the ability of cities to transfer revenue from their electric and water utilities to the City's General Fund; and WHEREAS, such a restriction would impose on the City of Lodi an annual loss in General Fund revenue of approximately $4.72 million (approximately 25%); and WHEREAS, the results of such a loss would impact dramatically on all City services, including public safety; and WHEREAS, this legislation represents a serious intrusion by the State into local rate setting authority; BE IT THEREFORE RESOLVED that the City Council of the City of Lodi hereby expresses its strongest opposition to Assembly Bill 318 and urges the State Senate to join in this opposition.
