Home My WebLink AboutAgenda Report - July 19, 1995 (54)`, of CITY OF LODI COUNCIL COMMUNICATION AGENDA TITLE: Resolution of the Lodi City Council Ordering the Thayer Reorganization Including Annexation the City of Lodi and Detachment from Certain Districts as Approved by LAFCO Located at 3883, 3921 and 3953 East Harney Lane (i.e. APN's 062-290-09, 10 and 11) MEETING DATE: July 19, 1995 PREPARED BY: Community Development Director RECOMMENDED ACTION: that the City Council adopt a Resolution ordering the Thayer Reorganization including annexation to the City of Lodi and detachment from certain districts as approved by LAFCO located at 3883, 3921 and 3953 East Harney Lane (i.e. APN'S 062-290-09, 10 and 11). BACKGROUND INFORMATION: The Thayer Reorganization consists of three parcels on 18.2 acres. The reorganization was initiated by City Council Resolution No. 95-59 on May 3, 1995. At its meeting April 19, 1995 the City Council introduced Ordinance No. 1616 which prezoned the parcel to R-2, Single -Family Residential except for a 1.25 acre parcel at the northeast corner of Stockton Street and Harney Lane which was prezoned C -S, Commercial Shopping. Reorganization must be approved by a Resolution which includes certain language as well as any special conditions required by LAFCO. The Local Agency Formation Commission approved the reorganization on June 16, 1995 with the condition that the approval be subject to the following: "The City's Resolution completing the reorganization shall state that the affected territory will remain within the boundary of County Service Area No. 53, Household Hazardous Waste. RESOLVED, BY THE CITY COUNCIL OF THE CITY OF LODI that it determines: a) Preliminary proceedings for the annexation of certain described territory to the City of Lodi and detachment from the Woodbridge Fire District and the SJC Resource Conservation District were initiated by the filing of the City of Lodi's Resolution No. 95- 59 with the Local Agency Formation Commission in the County of San Joaquin, proposing annexation of approximately 17.5 acres of property located 3883, 3921 and 3953 East Hamey Lane (APN's 062-290-09, 10 and 11), pursuant to the requirements of the Local Government Reorganization Act. b) Thereafter, appropriate proceedings were conducted by said Local Agency Formation Commission, and said Commission on June 16, 1995 adopted Resolution No. 932 approving the proposed annexation, subject to the terms and conditions set forth within the subject resolution. C) Resolution No. 932 of the Local Agency Formation Commission approving the proposed annexation also authorized the City of Lodi to complete proceedings for uninhabited reorganization without notice and hearing as the designated conducting agency in accordance with Section 57002(c) of the Government Code. Section 2. BE IT FURTHER RESOLVED, BY THE LODI CITY COUNCIL: a) That the proposal for annexation is ORDERED in accordance with Section 57002(c) of the Government Code of the State of California, to wit: Thayer Reorganization (contiguous) annexation to the City of Lodi. 2. Detachment of Thayer Reorganization from the Woodbridge Fire District and the SJC Resource Conservation District. 3. A description of said territory is attached hereto (Exhibit A) and made a part hereof, as though set out in full. Section BE IT FURTHER RESOLVED, that the affected territory shall remain within the countywide boundary of County Service 53, Household Hazardous Waste Management. THE CITY OF--LODI 18.6 AC = POINT OF BEGINNING EXHIBIT A .June 12, 1995 Description of Pronosed THAYER ANNEXATION TO THE CITY OF LODI San Joaquin County, California A portion of the southeast quarter (S.E. 1/4) of Section thirteen (13) and the northeast quarter (N. E. 1/4) of Section twenty-four (24), Township three (3) North, Range six (6) East, Mount Diablo Base and Meridian, more particularly described as follows: Beginning at the intersection of the southerly extension of the east line of Stockton Street with the south line of Harney Lane (50 feet wide), said intersection being on the Lodi City Limit line; thence along said City Limit line the following three (3) courses: (1) North 0041,30" West along said southerly extension and east line of Stockton Street, 817.01 feet to the southwest corner of that certain tract of land conveyed to Charles M.
