HomeMy WebLinkAboutAgenda Report - July 19, 1995 (38)of d CITY OF LODI COUNCIL COMMUNICATION c�trtr a't'`' AGENDA TITLE: Resolution of the Lodi City Council Ordering the California Waste Reorganization Including Annexation to the City of Lodi and Detachments from Certain Districts as Approved by LAFCO Located at the Eastern Terminus of East Turner Road, 650 Feet East of C1uffAvenue (i.e. APN 049-080-73) MEETING DATE: July 19, 1995 PREPARED BY: Community Development Director RECOMMENDED ACTION: that the City Council adopt a Resolution ordering the California Waste Reorganization including annexation to the City of Lodi and detachment from certain districts as approved by LAFCO located at the eastern terminus of East Turner Road, 650 feet east of Cluff Avenue (i.e. APN 049-080-73). BACKGROUND INFORMATION: The California Waste Reorganization consists of one parcel on 10.01 acres. The Reorganization was initiated by City Council Res. 95-37 on April 5, 1995. At its meeting of March 15, 1995, the City Council approved the request of Dillon and Murphy Engineering on behalf of California Waste Removal Systems to prezone the parcel to M-2, Heavy Industrial. Reorganization must be approved by a Resolution which includes certain language as well as any special conditions required by LAFCO. The Local Agency Formation Commission approved the reorganization on June 16, 1995 with the condition that the approval be subject to the following: "The City's Resolution completing the reorganization shall state that the affected territory will remain within the boundary of County Service Area No. 53, Household Hazardous Waste." RESOLVED, BY THE CITY COUNCIL OF THE CITY OF LODI that it determines: a) Preliminary proceedings for the annexation of certain described territory to the City of Lodi and detachment from the Mokelumne Fire District and the SJC Resource Conservation District were initiated by the filing of the City of Lodi's Resolution No.95-37 with the Local Agency Formation Commission in the County of San Joaquin, proposing annexation of approximately 10 acres of property located at the easterly terminus of Turner Road, 650 feet east of Cluff Avenue (APN 049-080-73), pursuant to the requirements of the Local Government Reorganization Act. b) Thereafter, appropriate proceedings were conducted by said Local Agency Formation Commission, and said Commission on June 16, 1995 adopted Resolution No. 931 approving the proposed annexation, subject to the terms and conditions set forth within the subject resolution. C) Resolution No. 931 of the Local Agency Formation Commission approving the proposed annexation also authorized the City of Lodi to complete proceedings for uninhabited reorganization without notice and hearing as the designated conducting agency in accordance with Section 57002(c) of the Government Code. Section 2. BE IT FURTHER RESOLVED, BY THE LODI CITY COUNCIL: a) That the proposal for annexation is ORDERED in accordance with Section 57002(c) of the Government Code of the State of California, to wit: California Waste (contiguous) annexation to the City of Lodi. 2. Detachment of California Waste Reorganization from the Mokelumne Fire District and the SJC Resource Conservation District. A description of said territory is attached hereto (Exhibit A) and made a part hereof, as though set out in full. Section 3. BE IT FURTHER RESOLVED, that the affected territory shall remain within the countywide boundary of County Service 53, Household Hazardous Waste Management.
