AGENDA TITLE: Adopt Resolution Approving Access to Criminal History (Fingerprinting)
Information For Employment (Including Volunteers) to the Human
Resources Director and/or his/her designee(s).

RECOMMENDED ACTION: That City Council adopt resolution approving access to Criminal
History Information (Fingerprinting) for employment (including
volunteers) to the Human Resources Director and/or his/her
designee(s)
BACKGROUND INFORMATION:
In March of 2001 the Department of Justice performed audits of California Public agencies to ensure
compliance with the Criminal Offender Record Clearance laws of California relating to the fingerprinting
of employees and volunteers.
Penal Code Section 11105(b)(10) and 13300(b)(10) require that governing boards of a city adopt a
resolution specifically authorizing access to summary Criminal History information (fingerprinting) for
employment purposes. In order to comply with the above mentioned Penal Codes
and for the Human Resources Department to continue receiving Criminal History information
(fingerprinting) we are requesting the above recommended action.
Additionally, staff will begin fingerprinting all prospective employees and volunteers as part of our
obligation for due diligence in hiring people who represent, and act on behalf of the City of Lodi.

RESOLUTION NO. 2001-201
A RESOLUTION OF THE LODI CITY COUNCIL APPROVING ACCESS TO
CRIMINAL HISTORY (FINGERPRINTING) INFORMATION FOR
EMPLOYMENT (INCLUDING VOLUNTEERS) TO THE HUMAN
RESOURCES DIRECTOR AND/OR HIS/HER DESIGNEE(S).

WHEREAS, in March 2001 the Department of Justice performed audits of California
Public Agencies to ensure compliance with the Criminal Offender Record Clearance laws of
California relating to the fingerprinting of employees and volunteers; and
WHEREAS, Penal Code Section 11105(b)(10) and 13300(b)(10) require that
governing boards of a city adopt a resolution specifically authorizing access to summary
Criminal History information (fingerprinting) for employment (including volunteers) purposes;
and
WHEREAS, in order to comply with the above-mentioned Penal Code Sections and
for the Human Resources Department to continue receiving Criminal History information
(fingerprinting), staff respectfully requests that the City Council adopt a resolution approving
access to Criminal History (fingerprinting) information for employment (including volunteers)
purposes by the Human Resources Director and/or his/her designee(s).
NOW, THEREFORE, BE IT RESOLVED, that the Lodi City Council does hereby
approve access to Criminal History (fingerprinting) information for employment (including
volunteers) to the Human Resources Director and/or his/her designee(s).
