RECOMMENDED ACTION: That the City Council adopt a resolution authorizing the City Manager to execute an
encroachment agreement with Union Pacific Railroad and appropriate funds in the
amount of $76,600.
BACKGROUND INFORMATION: The Electric Utility Department is in the design phase for a 60 kV line from
Industrial Substation to the new substation to be constructed west of Lower
Sacramento Road and south of Kettleman Lane. These facilities, substation
and 60 kV line, have been identified as needed facilities in the Department's growth plan to serve the load developing
on the west side of the City. The first segment of the line will be constructed from Industrial Substation to Harney
Lane along the Union Pacific Railroad (Central California Traction Company). This encroachment agreement permits
the line to overhang the railroad property along the above-mentioned route. The one time fee to the railroad for the
encroachment is $76,600.
The department is negotiating easements as well with several property owners along this route and will be bringing
agreements to the City Council for approval as such easements are obtained.
The preliminary cost estimate for this project (7.3 miles of line) is $2,500,000 including easements.

A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING
THE CITY MANAGER TO EXECUTE AN ENCROACHMENT
AGREEMENT WITH UNION PACIFIC RAILROAD, AND FURTHER
APPROPRIATE FUNDS FOR THE ENCROACHMENT FEE
WHEREAS, the Electric Utility Department is in the design phase for a 60kV line
from Industrial Substation to the new substation to be constructed west of Lower
Sacramento Road and south of Kettleman Lane; and
WHEREAS, these facilities, substation, and 60kV line have been identified as
needed facilities in the Department's growth plan to serve the load developing on the

WHEREAS, the first segment of the line will be constructed from Industrial

Company); and
WHEREAS, the encroachment agreement permits the line to overhang the

WHEREAS, the one-time fee for the encroachment is $76,600.00.
NOW, THEREFORE, BE IT RESOLVED, that the Lodi City Council hereby
authorizes the City Manager to execute an encroachment agreement with Union Pacific
Railroad; and
BE IT FURTHER RESOLVED, that funds in the amount of $76,600.00 be
appropriated for this encroachment fee from the Electric System Revenue Certificates of
Participation.
