AGENDA TITLE: Adopt resolution authorizing the City Manager to provide funding in the amount of $42,481.77
to fund the Public Benefits Program Grant — Stadium Cinema 12 F&H Construction Demand-
side Management Project (EUD)

RECOMMENDED ACTION: That the City Council adopt a resolution authorizing the City Manager to
provide funding in the amount of $42,481.77 to fund the Public Benefits
Program Grant — Stadium Cinema 12 F&H Construction Demand-side
Management Project. Energy efficiency improvements and upgrades will be incorporated into the new downtown Lodi
Stadium Cinema 12.
BACKGROUND INFORMATION: In conjunction with F & H Construction and Atlas Properties, Incorporated,
the City of Lodi Electric Utility identified and recommended various energy
efficiency/conservation improvements for the new downtown Lodi Stadium
Cinema 12 project. The developers of the project have installed the following high efficiency equipment, eligible for a
Public Benefits Program grant, under the category of demand-side management (energy efficiency/conservation):
• LED (light -emitting diode) exit signs;
• Compact fluorescent lamps;
• T-8 fluorescent lamps with electronic ballasts;
• Three (3) 15.5 -ton high efficiency heating & cooling units (energy efficiency rating of 10.3);
• Six (6) 10 -ton high efficiency heating & cooling units (energy efficiency rating of 11.0);
• One (1) 8.5 -ton high efficiency heating & cooling unit (energy efficiency rating of 10.8);
• Six (6) 7.5 -ton high efficiency heating & cooling units (energy efficiency rating of 11.0).
Under the guidelines of the City of Lodi Public Benefits Program, new commercial construction projects are
provided a rebate only for materials. The Public Benefits Program grant of $42,481.77 reflects 25 percent of the
total cost of the high efficiency equipment upgrades installed at the new theater. (NOTE: On June 20, 2009, the
Lodi City Council, at the recommendation and request of Electric Utility staff, reduced the percentage rebate
amount from 25% to 20%. The grant provided for the Stadium Cinema 121E & H Construction Project does reflect a
25% rebate. The project was already in progress, and some seventy-five percent complete, prior to the
amendment of the program guidelines on June 20, 2001).

A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE CITY
MANAGER TO PROVIDE A PUBLIC BENEFITS PROGRAM GRANT — DEMAND-
SIDE MANAGEMENT PROJECT TO STADIUM CINEMA 12 F&H
CONSTRUCTION
WHEREAS, the State has mandated that beginning January 1, 1998, the City of
Lodi is obligated to fund various programs through a Public Benefits Charge (PBC)
based on a historical electric revenue requirement; and
WHEREAS, the requirement amounts to approximately $1 Million per year that
must be dedicated to qualifying programs such as energy efficiency. A further stipulation
is that these efforts must be done on the customer's side of the meter in order to qualify;
and
WHEREAS, the Electric Utility Department recommends that the City provide a
Public Benefits grant of up to $42,481.77 to fund a Demand -Side Management Project
for Stadium Cinema 12 F&H Construction, reflecting 25% of the total cost of the high
efficiency equipment upgrades installed at the new theater; and
WHEREAS, under the guidelines of the City of Lodi Public Benefits Program,

Cinema 12 F&H Construction in the amount of $42,481.77.
