BACKGROUND INFORMATION: In 2000, the City Council directed staff to prepare a master plan for Roget Park. This was in response to a request from Public Works to drill a test well on the site. A plan was prepared and, following public notices and a series of meetings of the Parks and Recreation Commission, a site plan was approved. The plan includes a restroom with some active play areas on the west side of the park and a passive, walking area on the east side where most of the existing trees are located. The north -south street is shifted east to allow room for a well west of the street adjacent to the wall at Target. The site improvement project will consist of removing 86 dead, diseased and/or hazardous trees, seven clumps of shrubs, and some minor pruning and site clearing. This first phase is designed to clean up the park area and prepare it for future development. Removing the dead and diseased trees will reduce the spread of disease and the risk of fire. The minor pruning is primarily intended to make the park area more visible from the roadway and reduce illegal activities, such as dumping or loitering. This first phase of cleanup should be accomplished as soon as possible, regardless of the schedule for future construction. Due to some confusion regarding the contractor licenses, subsequent mowings, tree removal and subsequent pruning, staff recommends that all bids be rejected, revised specifications be approved and the project be rebid. The revised specifications are on file in the Public Works Department. FUNDING: Funds for the site work will be from Park Impact Mitigation Fees. Dixon Flynn -- CC01 AmendedRogetSiteMasterPln#TestWell#Improv 07/10/01 RESOLUTION NO. 2001-167 A RESOLUTION OF THE LODI CITY COUNCIL REJECTING ALL BIDS, APPROVING REVISED BID SPECIFICATIONS, AND AUTHORIZING READVERTISEMENT FOR BIDS FOR ROGET PARK SITE IMPROVEMENTS (PHASE 1) ------------------------------------------------------------- ------------------------------------------------------------- WHEREAS, in answer to notice duly published in accordance with law and the order of this City Council sealed bids were received and publicly opened on June 13, 2001 at 11:00 a.m. for the bid for Roget Park Site Improvements, described in the specifications therefore approved by the City Council on May 16, 2001; and WHEREAS, due to confusion regarding the contractor licenses, subsequent mowings, tree removal, and subsequent pruning, staff recommends that Council reject all bids, approve the revised specifications, and authorize readvertising for bids. NOW, THEREFORE, BE IT RESOLVED by the Lodi City Council that all bids received are hereby rejected for Roget Park Site Improvements, and hereby approves the revised specifications, and authorizes staff to readvertise for bids. Public Works Director CERTIFIED MAIL This letter is formal notification to you of City of Lodi staffs intention to recommend that the City Council award the bid for Roget Park Site Improvements, Phase I, to the second lowest. bidder, TruGreen LandCare. Although Berndt Tree Service was the low bidder, without optional bid items, with the addition of the optional bid items, TruGreen LandCare is the apparent low bidder. Pursuant to Section 2. Item 2.700, Award of Contract, we feel the following reasons make TruGreen LandCare's bid most advantageous to the City: 1) Optional Bid Item 4, Subsequent Mowing, was bid at $298 each compared to $700 each, a saving on each mowing of $402. 2) Optional Bid Item 5, Additional 20 Hours of Pruning, was bid at $38 per hour compared to $150 per hour. This would result in a savings of $2,240, based on twenty hours. If you do not agree with staff's recommendation to award to TruGreen LandCare, and believe that the City should award to you, despite points 1) and 2) above, you may file a letter of protest with the City of Lodi. Your letter should indicate why you believe the City should award to you. It should address the issues of optional bid item cost differences to the specifications. Your letter should be addressed to: Richard C. Prima, Jr., Public Works Director, City of Lodi, P.O. Box 3006, Lodi, CA 95242-3995. Your letter must be received by 8:00 a.m., Friday, July 6, 2001. The Public Works Director, or his designated representative, will respond to you prior to July 16, 2001. If you do not agree with the response, you will have the opportunity to address the Lodi City Council in opposition to staffs recommendation and in support of your proposal. The City Council's next meeting will be held Wednesday, July 18, 2001, at 7:00 p.m., Carnegie Forum, 305 West Pine Street. The decision of the City Council will be final.
