RECOMMENDED ACTION: That the City Council authorize the City Manager to begin negotiations with
Central Valley Waste Services, Inc., for the renewal of the franchise
agreement and authorize the City Manager to execute a professional services
agreement with a consultant to work with both parties to update the franchise
agreement for an amount not to exceed $20,000.
BACKGROUND INFORMATION: Under the existing franchise agreement with Central Valley Waste
Services, Inc. (CVWS), the City has the option of renewing the
agreement by giving notice to CVWS 18 months prior to July 2003.
Before we give that notice, there are some provisions of the agreement
that must be revisited. The original franchise agreement was approved in 1988 and has been amended a
number of times over the years.
It is staff's intent to hold public meetings where comments from the public would be received. The first
meeting of this type would be held in July. Information regarding new programs or other service suggestions
received through these meetings would be evaluated and, if appropriate, would become part of the
negotiation process.
The City is planning to do a major update to the existing franchise agreement to consolidate past
amendments and new changes. To do this, it would be in the City's best interest to hire a consultant familiar
with the industry and the regulations which must be included in a franchise. There are new regulations
regarding diversion goals and recycling, etc., that will be evaluated and, if needed, will be made part of the
franchise.
CVWS has given excellent service with reasonable rates. There was no increase in their rates this year.
CVWS is very interested in renewing the franchise and wants to work with the City to craft a mutually
beneficial agreement for the waste service franchise. A formal decision on the renewal of the franchise must
be made before December 2001.
