RECOMMENDED ACTION: That the City Council adopt a resolution authorizing the City Manager to
execute an agreement with the Lodi Veteran's Monument Foundation for
the All Military Veteran's Plaza project to be located at the
Civic Center Plaza and appropriate $450,000 for the project.
BACKGROUND INFORMATION: The City Council has previously approved the concept plan for the
All Military Veteran's Plaza project to be constructed within the
Civic Center Plaza between City Hall and Carnegie Forum. The
plans have been further reviewed with the public and refined by the
architect. The Foundation is prepared to make commitments with artists and other contractors to order
materials and begin fabrication of various components while final on-site construction plans are being
finalized.
The City Council also previously agreed in concept that the City would "front" funds for construction.
The attached short agreement between the City and the Foundation has been prepared to formalize this
understanding and to allow the City to reimburse the Foundation for their construction expenses.
Payments to the Foundation will be administered by the City Manager's office.

REPAYMENT AGREEMENT
This REPAYMENT AGREEMENT is made by and between the City of Lodi, a
municipal corporation ("City") and the Lodi Veteran's Monument Foundation, a California
non-profit 501(c)(3) corporation ("Committee") for the purpose of assisting Committee in
constructing a veterans memorial in the Civic Center Plaza between City Hall and
Carnegie Forum.
RECITALS:
The committee wishes to construct a veteran's memorial to honor all Lodi area
veterans of the Army, Navy, Air Force, Marines, World War II Merchant Marines, and
Coast Guard to be completed by Veterans Day 2001. However, the Committee has
insufficient time to raise the funds to construct the memorial consistent with its planned
completion date.
City is willing to provide advance funding for the construction of a veterans memorial in
the Civic Center Plaza between City Hall and Carnegie Forum in an amount not to
exceed $450,000 so long as the Committee agrees to raise funds to reimburse the City
the advanced funds.
TERMS AND CONDITIONS:
1. Project. Committee shall retain qualified persons to construct the memorial in
accordance with the concept plan approved by the City Council and detailed plans and
specifications approved by the Community Development Director and will dedicate the
improvements to the City upon completion.
2. Fundraising:. Committee shall use best efforts to raise funds toward the cost to
construct the Veterans memorial until the principal balance is paid in full. Committee
shall collect all funds it raises in trust for the City and shall pay 100 percent of all funds
donated to Committee to the City except for those funds expended on promotional
materials.
3. Payments: Committee shall tender to City on or before the first day of each
calendar year, beginning July 1, 2001 all amounts raised during the preceding calendar
year to pay for the Veterans Memorial. All agreed transactions shall take place at the
City of Lodi Finance Department, 212 West Pine Street, Lodi, California 95240.
5. Interest: No Interest shall accrue on the loan.

A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE
CITY MANAGER TO EXECUTE AN AGREEMENT WITH LODI
VETERAN'S MONUMENT FOUNDATION FOR THE ALL MILITARY
VETERAN'S PLAZA PROJECT TO BE LOCATED AT THE CIVIC
CENTER PLAZA, AND APPROPRIATE $450,000 FOR THE PROJECT
NOW, THEREFORE, BE IT RESOLVED, that the Lodi City Council does hereby
authorize the City Manager to execute an agreement with the Lodi Veteran's Monument
Foundation for the "All Military Veteran's Plaza" Project to be located at the Civic Center Plaza;
and
BE IT FURTHER RESOLVED, that $450,000.00 be appropriated from the General Fund
Capital Reserve for this project.
